2002-24765 Reso RESOLUTION NO. 2002-24765 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING A PUBLIC SAFETY COMMITTEE AND DEFINING ITS PURPOSE. WHEREAS, On June 6, 2001 Commissioner Luis R. Garcia, Jr. introduced the concept of a Public Safety Committee and the Mayor and Commission engaged in a discussion regarding the creation of such Committee, and referred the item to the Commission's Community Affairs Committee; and WHEREAS, The Community Affairs Committee voted unanimously for the Administration and Commissioner Garcia to convene a Public Safety Task Force meeting with other cities, counties and public safety experts to find out what steps to take in order to have a comprehensive approach to an emergency or disaster; and subsequently for the Administration to submit a proposal for a citizen-based Public Safety Committee; and WHEREAS, The purpose of the Public Safety Committee is to address public safety issues within our community and engage the appropriate public safety experts and representatives from the community to focus on issues such as the establishment of community emergency response teams to assist the City with emergency preparedness and other associated broad policy issues pertaining to public safety; NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that there is hereby established a Public Safety Committee ("Committee") which shall be responsible to provide the Mayor, Commissioners and the Administration with advice on policies related to public safety in the community as follows: 1. The Committee shall be comprised of seven (7) members with one (1) appointment to be made directly by the Mayor and each member of the Commission. Each appointee shall be a resident or a representative or member of the business community. The Committee will act as policy advisers in the area of community and public safety for both the City Commission and the Administration; 2. The Committee shall be constituted for a period of one (1) year with the Commission opting to extend this period at the conclusion of the one (1) year in which the Committee has met; 3. The appointed members of the Committee shall nominate and elect a Chair who shall head the Committee and with whom the Administrative Staff Liaison may coordinate meetings, agendas and other appropriate matters associated with the work of the Committee. The Committee will follow Roberts Rules of Order; 4. The Committee shall be responsible to provide the Mayor, Commissioners and the Administration with advice on policies related to public safety in the community. The charge of the committee is intended to be broad enough to encompass all aspects of community safety. Illustrative examples of issues the committee may chose to embrace include, but are not limited to, policy regarding infrastructure safety (streets, walkways, bike-paths), community level review of the City disaster response plan, participation in the Community Emergency Response Team and policy review of community risk assessment issues; 5. While the Committee's charge is intended to be broad in scope, it specifically excludes issues related to budget, operational policies and practices of the Police and Fire Departments and issues that are or might be the subject of collective bargaining with any of the City's bargaining units. The City Manager or his designee shall have the sole discretion to make determinations on the subject matter excluded from the committee's purview. PASSED and ADOPTED this 20th day of February ,2002. Issue: Shall the Commission create a Public Safety Advisory Committee to advise on broad policy related to community safety. Item Summary/Recommendation: Late in 2001, the Community Affairs Committee endorsed the pursuit of a community based Ad Hoc Task Force to discuss community safety, as well as, a longer term standing committee of the City Commission that would include citizens to discuss public safety concerns. The Ad Hoc Task Force Meeting has been conducted and the Administration is pursuing several different public safety issues as a result of the Task Force meeting. This Resolution will establish the standing Public Safety Advisory Committee that was endorsed by the Community Affairs Committee. The Resolution creates the Public Safety Advisory Committee and establishes its purpose. The purpose of the Public Safety Advisory Committee is specifically designated to be broad public policy advice only and it specifically excludes budgetary, operational or bargaining issue related discussions. The Commission can choose to adopt the Resolution in the form presented or may choose to refer the item to the Community Affairs Committee to discuss if other Commission committees might be candidates for consolidation into a new Public Safety Advisory Committee. To: Subject: ~ ii ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS Several months ago, Commissioner Luis R. Garcia, Jr. introduced the concept of a Public Safety Advisory Committee, which was subsequently endorsed by the Community Affairs Committee. The recommendation of the Community Affairs Committee was that a Task Force be convened of individuals interested or participating in community safety and that subsequently the Administration submit a proposal for a citizen based Public Safety Advisory Committee. Since the Community Affairs Committee recommendation, the Task Force meeting of concerned individuals in the community was convened. At this meeting, a wide variety of organizations and a wide variety of technical expertise associated with community safety were in attendance. Attached is a list of meeting attendees. The meeting was helpful in establishing some future direction and also in raising awareness on the overall subject of community safety. One action that emanated from the Task Force meeting was a risk assessment for the community and the development of certain plans and responses for said risks. The assessment is nearly completed. The City is also undertaking a review and revision of the All Hazard Response Plan (The Hurricane Plan) to incorporate the risk assessment and to better reflect this new knowledge of hazards and risks within the community. One very specific issue that became clear during the discussion at the Task Force meeting was that there was a need for two different groups within our community to focus on the issues attendant to public safety. One group should be a technical working group of community safety professionals that would be able to share information, interact with each other and to assure coordination of planning and resource utilization. This group would include those professionals in the community who are involved in the delivery of public safety services at their respective institution/agency/business. Further, it was clear that there was also a need for a different and separate citizen based group to focus on policy and very broad level concerns associated with public safety within our community. The need for a working technical committee that is not as public as a Commission Committee became very apparent as we further explored risk and security issues within our community. Many of the discussions and much of the information which might be developed in this context is such that it is not appropriate to share in public venues without compromising the information and further jeopardizing the security or safety of the particular institution in question. For example, ifthe Miami Beach City Hall is regarded as a potential site for an incident, full public disclosure and discussion of our plans to counteract actions or protect the facility would in essence give individuals desirous of creating an incident insight to allow an incident to successfully be pursued. The working technical group will be pursued and facilitated as needed and appropriate by administrative staff. The resolution addresses the need for a community or citizen based committee to address public safety issues within our community. As the Commission will note, this particular committee is suggested to be comprised of commission appointments of community representatives and their charge is broad and policy oriented. The committee is suggested to fill the role of policy advisers in the area of community and public safety for both the Administration and the City Commission. The role or duties of the Commission appointed Committee are outlined in the Resolution and includes policy advice on community public safety. The Committee would be involved in issues such as the establishment of community emergency response teams to assist the City with emergency preparedness, discussion and comment on the City's plans for disaster preparedness and other associated broad public policy issues. Also at a broad level the nearly completed risk assessment would be appropriate as a subject for the Committee. The attached Resolution also specifically identifies issues which are not within the purview of the suggested Public Safety Advisory Committee so that there is clarity and to help ensure the success of the Committee. Issues identified as inappropriate for the involvement of the Public Safety Advisory Committee include operating practices and procedures ofthe different public safety functions ofthe City, budgetary issues and issues which are or might be the subject of bargaining with any of the City's collective bargaining organizations. The issues that are not deemed appropriate for the Public Safety Advisory Committee are specified, as there are already organizations or avenues for those particular subjects to be reviewed and discussed. Having these particular issues or concepts discussed in a Public Safety Advisory Committee would be duplicative and would also alter the appropriate focus of the Committee from the desired public policy role. In the formation of the Public Safety Advisory Committee, the Commission may wish to consider the possibility of folding two existing committees into the new Public Safety Advisory Committee. The current Police Citizens Relations Committee and Safety Committee may be candidates for consolidation into a new Public Safety Advisory Committee. In this manner, the Commission might streamline our committee structure, avoid duplication and also be able to draw from current experienced and interested committee members to start the new Public Safety Advisory Committee. In the event the Commission would like to consider consolidating other existing committees, it would be recommended that this item be referred to the Community Affairs Committee for discussion prior to enactment.
