A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, AWARDING A
CONSTRUCTION CONTRACT TO REGOSA ENGINEERING,
INC., PURSUANT TO REQUEST FOR PROPOSAL NO. 21-00/01,
FOR THE CONSTRUCTION OF THE NORMANDY ISLE PARK
AND POOL FACILITY; APPROVING AND AUTHORIZING THE
APPROPRIATION OF FUNDS, IN THE AMOUNT OF $389,000
(COMPRISED OF $300,000 FROM THE FISCAL YEAR 2000/2001
NORTH BEACH QUALITY OF LIFE FUNDS, $89,000 FROM THE
$92 MILLION GENERAL OBLIGATION BOND FUND,
(COMPRISED OF $49,000 FROM THE NORMANDY ISLE AND
NORMANDIE sun NEIGHBORHOOD IMPROVEMENT
PROJECT AND $40,000 FROM THE ADA CITYWIDE
RENOVATION PROJECTS), TO COVER THE FOLLOWING
EXPENSES FOR THE CONSTRUCTION OF THE NORMANDY
ISLE PARK AND POOL FACILITY: $49,000 FOR THE
CONSTRUCTION OF 22 NEW ON-STREET PARKING SPACES
ON TROUVILLE ESPLANADE AND RUE GRANVILLE; $40,000
FOR THE CONSTRUCTION OF ACCESSmLE WALKWAYS AND
RAMPS; $80,288 TO COMPLETE THE CONSTRUCTION COST
FOR THE POOL FACILITY, AND $219,712 AS CONSTRUCTION
CONTINGENCY FUND.
WHEREAS, on January 31, 2001, the Mayor and City Commission authorized the
Administration to issue Request for Proposal No, 21-00/01 (RFP), for the construction of the Normandy
Isle Park and Pool Facility (the Project); and
WHEREAS, the RFP No. 21-00/01 was issued on March 16, 2001, and on May 17,2001, four
(4) responsive, and one (1) non-responsive, proposals were received; and
WHEREAS, the Administration established a seven (7) member evaluation committee to
review, evaluate, and make a recommendation regarding the proposals received; and
WHEREAS, on August 15, 2001, the proposers presented and discussed their respective
proposals with the evaluation committee, and
WHEREAS, after evaluating the contractors' experience and qualification, the evaluation
committee deliberated, and ranked Regosa Engineering, Inc" as the top ranked firm, and Jasco
Construction Co., Inc. as the second; and
WHEREAS, the City Manager concurred with the evaluation committee's deliberation and its
recommendation that the City conduct negotiations with the top ranked firm of Regosa Engineering,
Inc. and, if not successful, to conduct negotiations with the second ranked firm of Jasco Construction
Co., Inc.; and
WHEREAS, on September 5, 2001, the Mayor and City Commission approved and authorized
the negotiations with the top ranked firm, and appropriated funds in the amount of $2,553,932 to cover
the costs of construction, program management, and other related expenses for the Project; and

WHEREAS, value engineering sessions were conducted with the contractor, and the savings
which resulted were not sufficient to cover the budget shortfall for the construction of the Project ; and
WHEREAS, the available City budget allows the construction of the pool facility, and additional
funds are necessary to construct the appurtenant ramps and walkways, and to improve the twenty-two
(22) parking spaces on Rue Granville and Trouville Esplanade; and
WHEREAS, funding, in the total amount of $389,000; comprised of $300,000 from the North
Beach Quality of Life Funds, Fiscal Year 2000/2001; $40,000 from the General Obligation Bond Series
2000- ADA Citywide Renovations Project Fund; and $49,000 from the General Obligation Bond Series
2000- Normandy Isle and Normandy Sud Neighborhood Improvements Project Fund, was identified for
the Project; and
WHEREAS, on March 4, 2002, the General Obligation Bond Oversight Committee approved the
Administration's recommendation that the Mayor and City Commission appropriate an additional $89,000
from the G.O, Bond Fund for the Project; and
WHEREAS, the current budget of $2,264,000, comprised of the previously appropriated amount
of $2,175,000 and the additional $89,000, was determined to be sufficient to cover the cost of
construction of the aquatic facility, the on-street parking spaces, the ramps and walkways, the perimeter
fence, and pool night lighting and security lighting; and
WHEREAS, the Administration is also requesting the allocation by the Mayor and City
Commission of $300,000 in North Beach Quality of Life funding to cover the construction contingency,
which is currently unfunded; and
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby award a construction
contract to Regosa Engineering, Inc, pursuant to Request for Proposal No. 21-00/01, for the construction
of Normandy Isle Park and Pool Facility; approve and authorize, the appropriation of funds, in the
amount of $389,000 (comprised of $300,000 from the Fiscal Year 2000/2001 North Beach Quality of Life
Funds, $89,000 from the $92 Million General Obligation Bond Fund, (comprised of $49,000 from the
Normandy Isle and Normandie Sud Neighborhood Improvement Project and $40,000 from the ADA
Citywide Renovation Projects), to cover the following expenses for the construction of the Normandy Isle
Park and Pool Facility: $49,000 for the construction of 22 new on-street parking spaces on Trouville
Esplanade and Rue Granville; $40,000 for the construction of accessible walkways and ramps; $80,288
to complete the construction cost for the pool facility, and $219,712 as construction contingency fund.

Should Quality of life, G.O. Bond ADA, and G.O. Bond right-of-way funds be utilized to fund the Normandy
Isle pool facility, associated walkways and streetscape parking improvements and shall contract
negotiations and a contract be aooroved?
Item Summary/Recommendation:
Pursuant to a series of value engineering sessions conducted with the contracting firm of Regosa
Engineering Inc., substantial savings were achieved, but not sufficient to cover the budget shortfall for the
construction of the Normandy Isle Park and Pool project. The Administration identified $389,000 in Quality
of Life and G.O. Bond funds to cover the budget shortfall and to allow the construction of the pool facility
and appurtenant components, while actively pursuing Federal and State grants to cover the construction
expenses for the remaining unfunded components of the project. In community meetings, support to
complete the pool and to seek future funding sources for the park renovation has been expressed.
Therefore the Administration recommends that the Mayor and City Commission adopt the Resolution.
Advisory Board Recommendation:
. The North Beach Community concurred with the use of Quality of Life funding at its February 27,
2002 meeting.
. The G.O. Bond Oversight Committee recommended approval of funding at its meeting on March 4,
2002.

ANALYSIS:
As a point of information, the Normandy Isle Park and Pool Project was issued for bids in
late 2000. At that time, all the bids received significantly exceeded the available project
budget for construction. Pursuant to the Administration's recommendation, the City
Commission rejected all bids, Subsequently, on January 31,2001, the Mayor and City
Commission authorized the Administration to seek new proposals for the construction of
the Project. A Request for Proposal (RFP) format was adopted, This method of
procurement, unlike the bid system, would allow the Administration to negotiate with
prospective proposers if the new proposals were above the City's budget. Further, the
documents were also grouped in eight (8) principal components, The prospective
proposers were requested to provide two proposals: one for a lump sum cost, and another
separating the cost for the construction of each component. The eight components are as
follows:
1, Pool Building
2, Multipurpose courts
3, Site landscaping
4, Soccer field renovation
5. Walkways and entry features
6. Perimeter fencing
7, Lighting
8, On-street parking improvements
The new RFP format would allow the Administration to prioritize the construction of the
project per component, in the event that the value engineering process alone was
unsuccessful in addressing costs, and the project could not be brought within the available
budget without the drastic elimination of essential architectural features and programs,
Requestfor Proposal (RFP) # 21-00/01 was issued on March 16,2001. On May 17, 2001,
five (5) proposals were received, four (4) were deemed responsive, and one (1) non-
responsive, The proposals included all labor, materials, equipment and supervision
necessary to complete the Normandy Isle Park and Pool Project in accordance with the
specifications and drawings. Substantial completion must be attained within two hundred
seventy (270) calendar days after the issuance of the Notice to Proceed, and final
completion is to be attained thirty (30) calendar days following the substantial completion
date,
Pursuant to the evaluation of the proposals and the proposers' reference by City staff and
the City's consultant, on July 31,2001, the Administration established a seven (7) member
Evaluation Committee to review, evaluate, and make a recommendation regarding the

proposals received, (Letter to Commission (LTC) # 180-2001 dated July 31,2001), On
August 15, 2001, the proposers presented and discussed their respective proposals with
the Committee, who evaluated the experience and qualification of the general contractors
and sub-contractors; the experience and qualification of the pool sub-contractors; the price
proposals; the references of general contractors and pool sub-contractors; and the
respective methodologies and approaches for the construction of the project.
After the presentation of all the proposers, the Committee deliberated and ranked Regosa
Engineering, Inc" as the top ranked firm, and Jasco Construction Co" Inc. as the second
ranked firm, The City Manager concurred with the ranking of the Committee and its
recommendation to have the City conduct negotiations with the top ranked firm of Regosa
Engineering, Inc" and if not successful to conduct negotiations with the second ranked firm
of Jasco Construction Co" Inc, Moreover, during deliberation, the Committee members
understood the need for the Administration to have the option to prioritize the construction
of the project per component, as necessary,
The above recommendation constituted essentially the Resolution adopted by the Mayor
and City Commission on September 5, 2001. In addition, the City Commission
appropriated funds in the amount of $2,553,932 to cover the costs of construction, program
management, and other related expenses for the Project.
Pursuant to the approval of the City Commission, and authorization to conduct negotiations
with the first ranked contractor, the Capital Improvement Projects (CIP) Office, with the
assistance of URS Corporation, contacted Regosa Engineering. Thereafter, a series of
meetings were conducted to study and analyze different construction systems, methods
and material options to achieve the objectives set in the City Commission Resolution of
September 5, 2001, The Corradino Group and Parks and Recreation Department staffs
participated and were informed of the outcome of these meetings,
The following is a synopsis of the most salient changes resulting from the value
engineering sessions between the contractor, City staff and the City's consultants:
. Replacement of the specified concrete deck, appurtenant auger pile structural
foundation system, and pool deck finishes with a compacted sub-grade, compacted
lime rock base, sand base and concrete paver pool flooring deck system,
. Replacement of the specified aluminum fencing material with an electrostatic painted
steel material, 6' high maximum, and concrete piers at 50 feet.
. Replacement of the pool night lighting system specified with an approved equal
system.
. Revision of the specified storm drainage system,
. Replacement of the Miami Beach red concrete walkways with natural concrete
color walkways,

As a result of the analysis of the different options available, the study of the different
constructive methods and materials available for the project, and the review of the
original scope of work in comparison with the available construction budget, it was
determined that the current budget of $2,264,000 comprised of the original
$2,175,000 for hard construction and $89,000 for ADA improvements and on-street
parking improvements that is described below, will be sufficient to cover the cost of
construction of the aquatic facility, the on-street parking spaces, the ramps and
walkways, the perimeter fence, and pool night lighting and pool security lighting.
Additional items such as the Multi Purpose Court, Soccer field renovation, site
landscaping are not funded at this time, The Administration is also requesting the
appropriation by the Mayor and City Commission of $300,000 in Quality of Life
funding to cover the remaining unfunded portion of the project and also the
construction contingency, which is currently unfunded, It is not practical to proceed
with the project without a properly funded contingency.
The Administration is proposing to utilize other previously allocated G,O, Bond
funding for the construction of the following components included in the Normandy
Isle Park and Pool Project in order to complete the funding needed for the project:
1, On-street parkina.
. Seventeen (17) on-street parking spaces, east of the park, on Trouville
Esplanade.
. Five (5) on-street parking spaces, west of the park, on Rue Granville,
The Normandy Isle Park and Pool project is located in the Normandy Isle and
Normandie Sud Neighborhood. Trouville Esplanade and Rue Granville are
integral parts of the neighborhood improvements that are to be partly financed
by the $92 Million G.O, Bond Neighborhood Improvements. Therefore, the
Administration is proposing that $49,000 from the G.O, Bond fund Series 2000
be used to cover the cost of construction of the aforementioned twenty two (22)
on-street parking spaces from the Normandy Isle and Normandy Sud
Neighborhood Improvements, These parking improvements were originally
anticipated to be constructed in the neighborhood construction process, but will
be coordinated with the Normandy Isle Park and Pool project instead, Due to

the nature of the G,O, Bonds, it is appropriate for the neighborhood funds to be
used for the on-street parking improvements. There are no plans for parking
within the park, and Park Bond funds cannot be used for parking improvements
within the Right-of-Way,
2. ADA Improvements.
$1 Million from the 1999 G,O, Bond was earmarked for the provIsion of
accessibility for individuals with disabilities to City facilities, The City is obligated
under Title II of the American with Disabilities Act to provide access to the park,
the pool and any programs being conducted within. The walkways, sidewalks,
and ramps connecting the on-street parking to the aquatic facility and the park
fall within this category. Consequently, the Administration is proposing to fund
the construction of the aforementioned components totaling $40,000 from the
ADA Citywide Renovations Project included in the G,O. Bond Fund Series 2000,
On January 24, 2002, in a public meeting held at the Normandy Golf Course
Clubhouse, the Administration discussed the projects current status with the
community, The project's program and current budget shortfall were also reviewed,
The option to proceed with the construction phase of the pool portion of the project
was presented, along with two other options. The community supported the City
moving forward with the pool portion of the project and to seek funding to complete
unfunded park renovation portions. On February 27, 2002, the North Beach
community approved the use of $300,000 in Quality of Life funds for this project. On
March 4, 2002, the General Obligation Bond Oversight Committee approved a
request of the Administration recommending the appropriation of the additional
$89,000 from the G,O, Bond Fund by the Mayor and City Commission. The North
Beach Development Corporation will review the North Beach Community's
recommendation at their March 19,2002 meeting.
Therefore, the Administration recommends the adoption of the Resolution by the
Mayor and City Commission to appropriate $300,000 from Quality of Life funds and
$89,000 from the $92 million General Obligation Bond Fund to cover expenses for
construction of the Normandy Isle Park and Pool facility.
