2002-24810 Reso RESOLUTION NO. 2002-2481:0 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE PLACEMENT OF TEN (10) BANNERS FOR THE CARE RESOURCE AIDS WALK, TO BE HELD APRIL 21, 2002, AS REQUESTED BY THE APPLICANT AT THE FOLLOWING LOCATIONS: MCARTHUR CAUSEWAY, BETWEEN THE COAST GUARD STATION AND ALTON ROAD; 17TH STREET, ON THE NORTH EAST CORNER OF CONVENTION CENTER DRIVE; WASHINGTON AVENUE, CENTER POLE BETWEEN 5TH AND 6TH STREET; WASHINGTON AVENUE, CENTER POLE BETWEEN 8TH AND 9 TH STREET; WASHINGTON AVENUE, CENTER POLE BETWEEN 11TH AND 12TH STREET; WASHINGTON AVENUE, CENTER POLE BETWEEN ESPANOLA WAY AND 15TH STREET; AND WASHINGTON AVENUE, CENTER POLE BETWEEN 15TH AND 16TH STREET; SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT-OF-WAY, MEASURING 3 FEET X 7 FEET AND HAVING COPY AND DESIGN AS SHOWN ON THE ATTACHED DRAWINGS; TO BE INSTALLED AND REMOVED IN ACCORDANCE WITH ALL OTHER APPLICABLE CITY REQUIREMENTS; THE ADMINISTRATION FURTHER RECOMMENDS THAT THESE BANNERS BE INSTALLED NO EARLIER THAN APRIL 10, 2002, AND REMOVED BY APRIL 24, 2002. WHEREAS, The Care Resource AIDS Walk (Applicant) will be held on April 21, 2002, in the City of Miami Beach; and WHEREAS, in order to publicize the event and draw attention of the media and the public at large, the Applicant has requested light pole banners, measuring 3 feet by 7 feet; and WHEREAS, the Applicant has been through the required design review permit process in order to obtain approval for said banners; and WHEREAS, said banners are to be installed no earlier than April 10, 2002, and removed by April 24, 2002; and WHEREAS, the Applicant has requested approval and authorization for the placement of a total of ten (10) banners; and WHEREAS, the Applicant has posted a performance bond to ensure the removal of the banners by April 24, 2002, and will ensure that any damage to light poles will be repaired at its expense, and will meet all other applicable City requirements; and -/ WHEREAS, City Code Section 82-411 (d) requires that the Mayor and City Commission approve the installation of temporary banners. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve and authorize the placement of ten (10) banners for the Care Resource AIDS Walk, to be held April 21, 2002, as requested by the applicant at the following locations: MacArthur Causeway, between the Coast Guard Station and Alton Road; 17th Street, on the north east corner of Convention Center Drive; Washington Avenue, center pole between 5th and 6th Street; Washington Avenue, center pole between 8th and 9th Street; Washington Avenue, center pole between 11th and 12th Street; Washington Avenue, center pole between Espanola Way and 15th Street; and Washington Avenue, center pole between 15th and 16th Street; said banners to be affixed to light poles in the public right-of-way, measuring 3 feet x 7 feet and having copy and design as shown on the attached drawings; to be installed and removed in accordance with all other applicable City requirements; the administration further recommends that these banners be installed no earlier than April 10, 2002, and removed by April 24, 2002. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS The City Code Section 82-411 (d) requires that the City Commission approve the installation of temporary banners which reads, in part: (1) The rightto install, as well as the number, location and method of installation of banners shall be subject to the design review process and approved by the City Commission and the Public Works Department. Commission Memorandum April 1 0, 2002 Care Resource - AIDS Walk Page 2 (2) Banners shall not exceed three feet in width by seven feet in length. Banners may be double-sided. The color, design and material of all banners shall be approved under the design review process. (3) Banners announcing special events either to be held in City or to be associated in some manner with the city, as determined by the City Commission, may be erected up to 30 days prior to the event being announced and must be removed within seven days after such event. Special event banners shall require prior approval by the City Commission. (4) A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct banners to be removed at any time. The purpose of the banners is to promote the Care Resourc&AIDS Walk in the City of Miami Beach. The AIDS Walk is a 5-K Run, Walk, Blade, fundraising pledge event starting and ending at the Miami Beach Convention Center parking lot. The purpose is to raise money for services and treatments for those affected by HIVI AIDS who come to CARE Resource for assistance. If approval is granted, the proposed temporary banners are recommended to be installed, no earlier than April 10, 2002 and removed no later than April 24, 2002 by the banner company. The City Commission should approve the installation of the subject light pole banners for The Care Resource-AIDS Walk 2002, to be held in the City of Miami Beach on April 21 , 2002.
