Gonzalez A~~L City Manager ' COMPLIANCE WITH ES ENDING AT 11:00 P.M. Date: March 5, 2002 This Letter to Commission is to provide information regarding the level of compliance with the Miami Beach Ordinance regarding sales of alcohol after 11:00 p.m. The Miami Beach Police Department's Strategic Investigations Unit conducted an undercover operation and checked over 56 establishments after the ordinance was passed to 11:00 p.m. Only one store was found in violation of the ordinance during this period. A review of calls to the Miami Beach Police Department for service from two neighborhood gas stations on 5th Street revealed only one arrest during the last six months. Code Compliance has also been monitoring the results of the ordinance change from 10:00 p.m. to 11:00 p.m. Their investigation showed that restricting the hours of sale of alcoholic beverage for off-premise consumption has improved the quality of life for residents in several areas. An example of this improvement is evident on 5"~ and 6~ Streets between the Michigan and Jefferson Avenues. This area contains several gas stations and a number of grocery stores. This block has experienced a reduction in street litter (beer cans and bottles) and graffiti, as well as a decline in the number of homeless in the area. The Miami Beach Police Department and Code Compliance will continue to monitor compliance and provide updated information as it becomes available.
