Ordinance 1938ORDINANCE NO. 1938 AN ORDINANCE AMENDING ARTICLE 2, CHAPTER 31 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, BY ELIMINATING AND DELETING RESPONSIBILITY FOR WRESTLING MATCHES FROM THE JURISDICTION OF THE MIAMI BEACH BOXING COMMISSION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 31.2 of the Code of Miami Beach, Florida, which reads as follows: "The following words, when used in this article, shall for the purpose of this article, have the meanings respectively ascribed to them as follows: "EXHIBITIONS. Any show, encounter, fight, or match, with or without gloves, commonly considered a boxing or' ?Trestling match, the same being voluntary between two or more persons for money, prizes of any character, points or fame or any other thing of value, or upon the result of which any money or thing of value is bet or wagered, whether admission fees are charged or not, directly or indirectly. "PROMOTER. Any person, association or corporation engaged in advertising, en- couraging, promoting or bringing about an exhibition in the city." be and the same is hereby amended to read as follows: "The following words, when used in this article, shall for the purpose of this article, have the meanings respectively ascribed to them as follows: "EXHIBITIONS. That that portion of Section 31.3 of the Code of Miami Beach, Florida, which reads as follows: "The commission shall regulate and supervise and have jurisdiction over all pugilistic, boxing, wrestling or similar public exhibitions in the city." be and the same is hereby amended to read as follows: "The commission shall regulate and supervise and have jurisdiction over all pugilistic, boxing, or similar public exhibitions, contests or matches in the city." SECTION 3. That Article 2, Chapter 31 of the Code of the City of Miami Beach, Florida, be and the same is hereby amended by adding a new Section thereto to follow immediately after Section 31.6, and to be numbered and to read as follows: "31.6.1 - The facilities of the Boxing Commission in the Municipal Auditorium being necessary and essential to the conduct and staging of wrestling programs, a fee of One Hundred Fifty Dollars ($150.00) for each such wrestling proarAm, shall be paid to the Boxing Commission for the use of said facilities." SECTION 4. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. SECTION 5. That this Ordinance is adopted as an emergency measure under the provisions of Section 9 of the Charter and shall be effective immediately. PASSED and ADOPTED this 18th day of OCTOBER, 1972.
