AN ORDINANCE AMENDING CHAPTER 20 OF THE CODE
OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING
AND CHANGING THE PENALTY DATE AND PROVIDING
FOR REFUND FOR PENALTIES PAID
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 20-4.1 be and the same is hereby amended
to read as follows:
"Sec. 20-4.1. Penalty for late payment.
All licenses shall be sold by the city
clerk beginning September 1 of each year
and shall be due and payable on November
1 of each year and shall expire on Sep-
tember 30 of the succeeding year. Those
licenses not renewed through November 2 shall
be considered delinquent and subject to
a delinquency penalty of ten percent (10%)
for the month of November, plus an addi-
tional five percent (5%) penalty for each
month of delinquency thereafter until paid;
provided that the total delinquency penalty
shall not exceed twenty-five percent (25%)
of the occupational license fee for the
delinquent establishment.
Any person engaging in or managing any
business, occupation or profession without
first obtaining an occupation license,
required hereunder, shall be subject to a
penalty of twenty-five percent (25%) of
the license determined to be due, in
addition to any other penalty provided by
law or ordinance."
SECTION 2. The City Clerk and Finance Director is hereby
authorized, empowered and directed to refund, upon
application, to any person any amount received and collected
by said City Clerk and Finance Director from such person as a
penalty for having failed to make payment of the license fee
imposed by this Chapter on or before October 1, 1972.
SECTION 3. That all Ordinances or parts of Ordinances in
conflict herewith be and the same are hereby
repealed.
SECTION 4. That this Ordinance is adopted as an emergency
measure under the provisions of Section 9 of the
Charter and shall be effective immediately.

having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 2nd day of November, 1972,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
