AN ORDINANCE AMENDING ARTICLE III, CHAPTER 2,
OF THE CODE OF THE CITY OF MIAMI BEACH, FLO-
RIDA, PROHIBITING ANY PERSON HOLDING THE
OFFICE OF MUNICIPAL JUDGE IN THE CITY FROM
ACCEPTING PROFESSIONAL EMPLOYMENT OR PRACTICING
LAW IN THE COUNTY COURT, IN AND FOR DADE COUNTY,
FLORIDA, WHEREIN A POLICE OFFICER, OR OTHER
OFFICER OR EMPLOYEE OF THE CITY MAY OR WILL
APPEAR AS A PARTY OR WITNESS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 2.44, Article III, Chapter 2, of the
Code of the City of Miami Beach, Florida, be and
the same is hereby amended by adding an additional paragraph
thereto, the same to be numbered and to read as follows:
"(8) No person holding the Office of
Municipal Judge of the City of Miami
Beach shall accept any professional
employment, or appear as an attorney
in any cause, matter, or proceeding,
in the County Court, in and for Dade
County, Florida, when he knows or may
be reasonably expected to know, that
a police officer or other officer or
employee of the City of Miami Beach
will be a party or witness in such
cause, matter, or proceeding in said
County Court."
SECTION 2. That all Ordinances or parts of Ordinances in
conflict herewith be, and the same are hereby
repealed.
SECTION 3. This Ordinance shall go into effect immediately,
upon passage and posting as required by law.

having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 8th day of February, 1973,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
