AN ORDINANCE AMENDING ORDINANCE NO. 1582,
BEING THE MINIMUM HOUSING STANDARDS
ORDINANCE OF THE CITY OF MIAMI BEACH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 1.06(2) of Ordinance No. 1582, being
the Minimum Housing Standards Ordinance of the
City of Miami Beach, Florida, defining a "basement," and reading
as follows:
"A portion of a building located partly
underground, but having less than half
its clear floor -to -ceiling height below
the average grade of the adjoining ground."
be and the same is hereby amended to read as follows:
"That portion of a building between floor
and ceiling, which is so located that one-
half or more of the clear height from floor
to ceiling is below grade."
SECTION 2. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby
repealed.
SECTION 3. That City Council finding that there is a public
emergency affecting health, property and job
safety, this ordinance is adopted as an emergency measure
pursuant to the provisions of Section 9 of the Charter of
the City of Miami Beach and shall go into effect immediately
upon its passage.

Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 23rd day of February, 1973
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
