AN ORDINANCE OF THE CITY COMMISSION OF

THE CITY OF MIAMI BEACH, FLORIDA AMENDING
SECTION 45 . 7 OF THE CODE OF THE CITY OF
MIAMI BEACH, FLORIDA, BY ADDING THERETO
SUB-SECTION ( h ) WHICH PROVIDES FOR THE
TRANSFERABILITY OF WATER DEPOSITS FROM
ACCOUNT( S) OF DECEASED OWNERS/OCCUPANTS
TO ACCOUNT (S) OF SURVIVING
OWNERS/OCCUPANTS WITH HOMESTEAD CLAIMS
WHO CAN SHOW PROOF OF JOINT OWNERSHIP OR
JOINT OCCUPANCY FOR CERTAIN RESIDENTIAL
SINGLE-FAMILY DWELLINGS AND APARTMENT
HOUSES ; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH ; PROVIDING FOR
SEVERABILITY ; AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1 : Section 45 . 7 of the Code of the City of Miami Beach,
Florida, by adding sub-section (h)
Section 45 . 7 Application and contract .
(h) Upon the death of an owner/occupant who has made a
guarantee of payment deposit for a residential single-family
dwelling or apartment house and where the surviving
owner/occupant has a homestead claim, transfer of a guarantee of
payment deposit is allowed to a surviving owner/occupant who can
show proof of joint ownership or joint occupancy during the
period in which the water supply service was in effect for the
premises .
SECTION 2 . REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3 . SEVERABILITY:
If any section, sentence, clause or phrase of this ordinance is
held to be valid or unconstitutional by any court of competent
jurisdiction , then said holding shall in no way affect the
validity of the remaining portions of this ordinance.

SECTION 4 . EFFECTIVE DATE.
• This ordinance shall take effect ten ( 10 ) days after its adoption
on November 28 , 1987 .
