Ordinance 73-1968ORDINANCE NO. 73-1968 AN ORDINANCE AMENDING ORDINANCE NO. 1605 OF THE CITY OF MIAMI BEACH, FLORIDA ESTABLISHING A COMPENSATION PLAN FOR OFFICES AND POSITIONS IN THE UNCLASSIFIED SERVICE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION I. That Ordinance No. 1605, being an Ordinance of the City of Miami Beach, Florida, establishing a Compensation Plan for offices and positions in the Unclassified Service of the City, be and the same is hereby amended to read as follows: "Section 1. The following shall constitute the Compensation Plan for the offices and positions in the Unclassified Service which are hereby created or re-created in accordance with the following organization plan, and a schedule of rates of salaries effective October 1, 1973, for said offices and positions is hereby established as follows: BI -WEEKLY COMPENSATION Ran e A. The pay rate steps as set forth in Table X, attached hereto and made a part hereof, shall be the basis for pay ranges to which classifications in Section 2 of this ordinance are assigned. SECTION 3. City Manager is hereby authorized to issue detailed regulations, in conflict with this ordinance for the purpose of clarification of this ordinance. The City Manager shall fix rates of compensation yees within the limitations prescribed in this ordinance. (a) When an employee shall have completed seven years employment, he shall be paid a sum equal to two and one-half per cent (22%) of his base pay in addition to the amount he is paid under Section 1 or Section 2 hereof. (b) When an employee shall have completed ten years employment he shall be paid a sum equal to five per cent (5%) of this base pay in addition to amount he is paid under Section 1 or Section 2 hereof. (c) When an employee shall have completed fifteen years employment, he shall be paid a sum equal to seven and one-half per cent (Th7.) of his base pay in addition to the amount he is paid under Section 1 or Section 2 hereof. (d) When an employee shall have completed twenty years employment, he shall be paid a sum equal to ten per cent (10%) of his base pay in addition to the amount he is paid under Section 1 or Section 2 hereof. (e) When an employee shall have completed twenty-five years employment, he shall be paid a sum equal to eleven per cent (11%) of his base pay in addition to the amount he is paid under Section 1 or Section 2 hereof. For provisions of this section, length of employment shall include all time spent as an employee in the Unclassified or Classified Service regardless of status for which compensation has been paid and time while on approved military leave for service in the Armed Forces of the United States, provided, however, that in the event an employee is absent from his duties because of service -connected injury, for which Workmen's Compensation is payable, is certified by the City Physician to be physically able to return to his duties, and fails to do so, the period between such certification and the employee's actual return to his duties shall not be deemed to be service time within the meaning of this sub -paragraph. SECTION 5. (a) The City Manager is authorized to approve rates of compensation less than the prescribed minimums for employees whose employment is on a part time basis, or whose duties and responsibilities are clearly less than normally attached to a position. (b) The City Manager may authorize compensation not more than twenty percent (20%) in excess of the maximums prescribed in Section 1 or Section 2 of this ordinance for those employees whose duties and responsibilities are clearly above and beyond the normal scope of positions within their job class; and the City Manager may authorize compensation in excess of the maximums prescribed in Section 1 or Section 2 of this ordinance for those employees who are required to work substantially beyond the normal work hours of their positions. SECTION 6. It is declared to be the purpose of this ordinance to provide an orderly and fair means for the compensation of employees in the Unclassified Service of the City of Miami Beach, Florida, on the basis of the work they perform and their competence in its performance; and to provide an equitable basis of compensation and reward for merit. Nothing herein shall be construed to prevent the withholding of pay increases or the reduction of pay rates for disciplinary purposes. -4 - SECTION 7. If any portion of this ordinance shall be declared invalid, the remaining portions shall have the same force and effect as though such invalid portion or portions had not been included. SECTION 8. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 9. This ordinance shall become effective as of October 1, 1973. SECTION 10. This ordinance is hereby adopted as an emergency ordinance under the provisions of Section 9 of the City Charter.
