Ordinance 90-2716 ORDINANCE 1O. 90-2716 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLOIDA, AMENDING SECTION 14- 5 OF THE MIAMI BEACH CITY CODE, SAID SECTION ENTITLED "PENALTIES FOR VIOLATION-LIFE SAFETY CODE" PROVIDING THAT VIOLATIONS OF THE PROVISIONS OF CHAPTER 14 BE BROUGHT BEFORE A SPECIAL MASTER PURSUANT TO CHAPTER 9B OF THE MIAMI BEACH CITY CODE; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA. SECTION 1. That Section 14-5 of the Miami Beach City Code, said section entitled "Penalties for Violation-Life Safety Code" is hereby amended to read as follows: SECTION 14-5. PENALTIES FOR VIOLATION--LIFE SAFETY-- -CODE. OF FIRE CODES AND ENFORCEMENT. Any person, firm or corporation who shall violates or fails to comply with any of the--prev-i-s-i-en of E� ptc - - s 2 . 1. 5, of the National.Fire Proteet-ion A- . . = , .. : -. Bion No. 1-9-3- otherwise knewn as the-wife Safety Code, 1-9&5 ed-r—i-e-ri, the minimum standards established and adopted by this Chapter as may be amended, shall upon conviction, be fined not less than one hundred dollars for the first violation and not less than one thousand dollars for each subsequent violation. In addition, the county judge may, in his discretion, impose an additional penalty of imprisonment for a period of up to ninety days. Each day such violation shall be permitted to exist_ shall constitute a separate offense. As an alternative method of enforcement, any personfirm or corporation who violates or fails to comply with any of the minimum standards established and adopted by this Chapter and who fails to comply_with a final order -'-Sued in accordance with the provisions • o this Chapter maw be subject to enforcement procedures before a Special Master of the City of Miami Beach and to penalties as set forth in Chapter 9B of this Code. SEVERABILITY If any section, sub-section, sentence, clause, phrase or portion of this ordinance is, for any reason, held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this ordinance.
