AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING MIAMI
BEACH CITY CODE SECTION 8-3 OF CHAPTER 8
ENTITLED "BUILDING REGULATIONS", VIA SECTION
8-3 (G) (3) ENTITLED "SCHEDULE OF PERMIT FEES"
SO AS TO PROVIDE FOR PERMIT FEES AND
INSPECTION FEES FOR ELEVATORS, ESCALATORS AND
OTHER LIFTING APPARATUS; AND FURTHER AMENDING
SECTION 8-3 (G) (4) ENTITLED "AMUSEMENT RIDES
AND DEVICES" SO AS TO PROVIDE FOR THE
VERIFICATION OF THE CERTIFICATE OF SAFETY
ISSUED BY THE STATE OF FLORIDA FOR AMUSEMENT
RIDES AND DEVICES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1:
That Subpart (g) (3) of Section 8-3 of Miami Beach City Code
Chapter 8 entitled "Building Regulations" is hereby amended to read
as follows:
(g) MECHANICAL PERMIT FEES.
(3) ELEVATORS, ESCALATORS AND OTHER LIFTING APPARATUS:

SECTION 3 : REPEALER
All ordinances or parts of ordinances in conflict therewith be
and the same are hereby repealed.
SECTION 4: SEVERABILITY
If any section, sentence, clause or phrase of this ordinance
is held to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding shall in no way affect the validity

or the remaining portions of this ordinance.
SECTION 5: EFFECTIVE DATE
This ordinance shall take effect ten (10) days after its
adoption on November 3 , 1990.

DEVICES"
The revision of this ordinance is necessary to encompass
the agreement with the State of Florida whereby the City
will assume jurisdiction to inspect all elevators and
escalators within our city limits.
ADMINISTRATION RECOMMENDATION:
The Administration recommends that the fee schedule be
adopted since it is a companion to the agreement with the
State to inspect elevators.
