Ordinance 76-2073 ORDINANCE NO. 76-2073 AN ORDINANCE AMENDING SECTION 7-3 (B) OF ORDINANCE NO. 1891, BEING THE ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, SO AS TO PERMIT ACCESSORY RESTAURANT USES IN THE RM-125 MULTIPLE FAMILY HIGH DENSITY USE DISTRICT SO AS TO PERMIT ACCESSORY RESTAURANT USES THEREIN TO BE USED BY THE GENERAL PUBLIC, AND TO PERMIT SUCH ACCESSORY RESTAURANT USES IN SAID RM-125 MULTIPLE FAMILY HIGH DENSITY USE DISTRICT TO ADVERTISE THE EXISTENCE OF SUCH ACCESSORY RESTAURANT USE TO THE GENERAL PUBLIC; PROVIDED, HOWEVER, THAT NOTHING HEREIN CONTAINED SHALL AUTHORIZE OR PERMIT THE USE OF THE EXTERIOR SIGNS PROHIBITED BY SECTION 7-2 (D) . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 7-3 (B) of Ordinance No. 1891, being the Zoning Ordinance Qf the City of Miami Beach, Florida, be and the same is hereby amended by adding a new paragraph thereto immediately following Paragraph 5, to be numbered and to read as follows: "5. (a) Accessory Restaurants shall be permitted in RM-125 Multiple Family High Density Use Districts and may be used by the general public, and such accessory restaurant uses shall be permitted to advertise the existence of such accessory restaurant use to the general public; provided, however, that nothing herein contained shall authorize or permit the use of the exterior signs prohibited by Section 7-2 (D) . " SECTION 2: That all ordinances or parts of ordinance in conflict herewith be and the same are hereby repealed. SECTION 3: That this ordinance shall become effective ten (10) days after passage .
