Ordinance 76-2082 ORDINANCE NO. 76-2082 AN ORDINANCE AMENDING SECTION 8-3 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, TO HAVE UNIFORM INSPECTION AND PERMIT FEES; ESTABLISH A PREMISE PERMIT FEE MAKING THE SAME A PART OF SAID CODE AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 8-3 of the Code of the City of Miami Beach, Florida, is hereby amended to read as follows : "Sec. 8-3. Schedule of permit fees. Permit fees of the Building Inspection Division of the City are hereby levied and imposed as follows : (A) DOUBLE FEES : When work for which a permit is required is commenced prior to the obtaining of a permit, the fees, as specified herein, may be doubled, but in no event shall such doubled fee be less than Twelve and 50/100 Dollars ($12 . 50) . The payment of such double fee shall not relieve any person, firm or corporation from fully complying with all of the requirements of all applicable regulations and codes, nor shall it relieve them from being subject to any of the penalties therein. The double fee require- ment shall be applicable to all sections of the building division. Minimum fee $12 . 50 (B) REINSPECTION FEES: When extra inspection trips are necessary due to (1) wrong address being given on call for inspec- tion, (2) prior rejection of work due to faulty construction, (3) work not being ready for inspection at time specified, (4) failure to call for final or other inspections, (5) required corrections not being made or completed at time specified, a fee of Ten Dollars ($10. 00) for each reinspection may be charged. The payment of reinspection fees may be required before any further permits will be issued to the person or firm owing same, and further inspec- tions may be refused until payment of reinspection fees have been made. Reinspection of existing buildings by all divisions to determine compliance with the South Florida Building Code, but not annual inspections as required by 305. 1 (d) $10. 00 (C) REFUNDS, TIME LIMITATION, REVOCATION, ETC. : The fees charged pursuant to this ordinance pro- vided the same are for a permit required by Section 301. 1 of the South Florida Building Code, may be refunded by the Director of the Code Enforcement Department subject to the following: • OFFICE OF THE CITY ATTORNEY , 1130 WASHINGTON AVENUE 'MIAMI BEACH, FLORIDA 33139 (1) No refund shall be made where any work has commenced except where duplicate permits are issued for the same work, in which case a refund in accordance with item 4 may be granted to the prior issued permit holder providing the duplicate permits were issued within ninety (90) days of each other and request for refund is received within ninety (90) days of the issuance of the latter permit. (2) No refunds shall be made where permit has become void as provided by para- graph 304 . 3 (a) of the South Florida Building Code. (3) No refunds shall be made on permit fees of Four Dollars ($4. 00) or less. (4) Refunds on permits or any item thereon where fees are over Four Dollars ($4. 00) will be refundable on a basis of eighty percent (80%) of the balance over Four Dollars ($4 . 00)„ such refunds to be made to the closest dollar. (5) Full refunds may be granted to a permit holder whose permit is cancelled by owner authorization where work has com- menced and such owner selects a second contractor to complete the work. The second contractor shall pay a full fee to complete the work unless the first contractor waives his opportunity to a refund in writing, in which case, the second contractor is entitled to a per- mit to cover the same work on a 'no charge' basis. (6) A full refund may be granted to a permit holder who takes out a permit covering work outside the jurisdiction inspection area. (D) BUILDING PERMIT FEES: (Fees listed here do not include plumbing, electrical or mechanical installations or use and occupancy fees. ) (1) NEW BUILDING AND/OR ADDITIONS: For each 100 sq. ft. or fractional part of floor area $ 3. 00 Minimum fee $15. 00 Except that for buildings for storage and industrial uses of the Group E and F Occupancies as defined in the South Florida Building Code, the fee shall be: For each 100 sq. ft. , or fractional part of floor area up to 20 , 000 sq. ft $ 3. 00 For each additional 100 sq. ft. or fractional part of floor area thereafter $ 1. 50 Minimum fee $12 . 00 - The premise fee shall be computed by multiplying the total number of such employees times twenty-five dollars ($25. 00) . The minimum premise permit fee shall be five hundred dollars ($500. 00) - 14 - • OFFICE OF THE CITY ATTORNEY 1130 WASHINGTON AVENUE MIAMI BEACH, FLORIDA 33139 (I) CERTIFICATE OF USE AND OCCUPANCY: In order to obtain a certificate of use and occupancy as required by Ordinance No. 1891, City of Miami Beach, the following original fees shall be paid for the purpose of defraying the costs of the original necessary zoning inspection; and the annual renewal fees, as set forth herein, shall be paid to defray the cost of periodic zoning inspection that is necessary due to the nature of the use in order to determine that the use is being maintained in compliance with zoning requirements as well as conditions or restric- tions prescribed by zoning resolutions and the chapter. The renewal fee is based on change of use, change of ownership and/or change of tenant. No refunds shall be made of fees paid for use and occupancy permits. It is the intention of the City Councilmen and it is hereby ordained that the provisions of this Ordinance shall become and be made part of the Code of the City of Miami Beach, Florida, that the sections of this Ordinance may be renumbered or relettered to accomplish such intention and that the word "ORDINANCE" may be changed to "SECTION" , "ARTICLE" , or other appropriate word. SECTION 3. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4. This ordinance shall become effective November 15 , 1976.
