AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH AMENDING SECTION 7-1 (D) , SECTION
13-6 (E) (1) AND SECTION 16-2 (C) OF ZONING ORDI-
NANCE NO. 1891 SO AS TO PROVIDE FOR AN INCREASE
IN THE FEES CHARGED TO APPLICANTS IN CONNECTION
WITH PUBLIC HEARINGS FOR VARIANCES BEFORE THE
ZONING BOARD OF ADJUSTMENT AND CHANGE OF ZONING
REQUESTS BEFORE THE PLANNING BOARD AND CITY
COMMISSION.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1: That Section 7-1 (D) of Zoning Ordinance No. 1891 of the
City of Miami Beach, Florida, be and the same is hereby
amended by adding a new paragraph thereto as follows:
"Any applicant requesting and obtaining a public
hearing before the Planning Board on an appli-
cation for a conditional use shall pay the sum
of Two Hundred Dollars, ($200 . 00) . Applicants
using the conditional use process for approval
of PUD applications, as described in Section
6-3 (K) (2) , shall pay a fee of One Hundred
Dollars ($100. 00) . The above fees are for the
purpose of defraying expenses of public notices
and other administrative costs in connection
with said hearing. "
SECTION 2 : That Section 13-6 (E) (1) of Zoning Ordinance No. 1891 of
the City of Miami Beach, Florida, reading as follows:
"Any person requesting and obtaining a public
hearing on an application for a variance be-
fore the Board shall pay, upon the adoption
of a motion or resolution calling a public
hearing, the sum of Fifty ($50. 00) Dollars
as costs to defray the expenses of public
notices and other administrative costs in
connection with said hearing. "
be and the same is hereby amended to read:
"Any person requesting and obtaining a public
hearing on an application for a variance be-
fore the Board shall pay, upon the adoption
of a motion or resolution calling a public
hearing, the following fees:
a. Single-Family Residences--$100 filing
fee plus $25 for each individual variance
requested.
b. Parking requirements for allowable com-
mercial uses in existing structures--
$100 filing fee plus $25 for each
individual variance requested.
c. Multi-Family and Commercial properties--
$200 filing fee plus $50 for each
individual variance requested.
If a deferment is requested by the applicant,
an additional fee shall be assessed, as follows:

Single-Family $50
Parking requirements for allowable
commercial uses in existing structure $50
Multi-Family and Commercial properties $100
If a deferment is given by the Board of Adjustment,
and not at the request of an applicant, there will
be no additional fee.
If an applicant removes his file from the Agenda
after it has been accepted by the Zoning Section,
the Board shall refund 50% of all fees paid by
the applicant and no further refund shall be made.
The above fees are for the purpose of defraying
expenses of public notices and other administra-
tive costs in connection with said hearing. "
SECTION 3: That that portion of Section 16-2 (C) of Zoning Ordinance
No. 1891 of the City of Miami Beach, Florida, reading
as follows:
"Any petitioner requesting and obtaining a public
hearing on an application for change of zoning or
other amendment to this Ordinance shall pay, upon
the adoption of the resolution calling the public
hearing required hereby, the sum of Seventy-five
($75. 00) Dollars as costs of publishing and mailing
the notices required by this Section. "
be and the same is hereby amended to read:
"Any petitioner requesting and obtaining a public
hearing on an application for change of zoning or
other amendment to this Ordinance shall pay, upon
the adoption of the resolution calling the public
hearing required hereby, the following fees:
a. Change of Zoning--Three Hundred Dollars ($300. 00) .
b. Amendment to the Zoning Ordinance not involving
a zoning change, requiring newspaper noticing
only--Two Hundred Dollars ($200. 00) .
c. Amendment to the Zoning Ordinance requiring
individual mailing, plus newspaper notices--
Three Hundred Dollars ($300. 00) .
The above fees are for the purpose of defraying
expenses of public notices and other administrative
costs in connection with said hearing. "
SECTION 4: All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 5: This Ordinance shall go into effect upon its passage
in accordance with law.
