AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AMENDING CHAPTER 17B
OF THE CODE OF THE CITY OF MIAMI BEACH BY
ADDING A NEW SECTION THERETO TO BE NUMBERED
17B-3-2 SO AS TO PROTECT TENANTS IN THEIR
RIGHTS TO PRESENT COLLECTIVE GRIEVANCES
WITHOUT FEAR OF REPRISAL
AND PROVIDING PENALTIES FOR THE VIOLATION
THEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1: That Chapter 17B of the Code of the City of Miami Beach
be and the same is hereby amended to add a new section
thereto immediately after Section 17B-3-1, to be numbered and to
read as follows:
"Section 17B-32
(1) That any tenant or group of tenants may
at any time submit ii oral or written form a
list of grievances to the landlord, his
agents or to any proper governmental agency
concerning the management, the physical con-
ditions or operation of the rental unit or
units.
(2) The management of any rental unit com-
plained against or criticized shall not coerce,
retaliate, or discriminate in any manner against
a tenant or tenant group because he had partici-
pated in the presentation of a grievance or
complaint.
(3) Any person convicted of violating any
provision of this Ordinance shall, upon convic-
tion in the Metropolitan Court, be subject to
a fine not to exceed five hundred dollars
($500. 00) or imprisonment in the County jail
for not more than sixty (60) days or by both
such fine and imprisonment.
(4) It shall be unlawful for any person to
willfully and knowingly initiate any complaint •
under the provisions of this Ordinance without
probable cause and for the purpose of harass-
ment. Any person convicted of violating this
section shall be subject to a fine or imprison-
ment as hereinabove provided. "
SECTION 2 : All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3: This Ordinance shall go into effect ten (10) days
after its passage.
