AN ORDINANCE AMENDING CHAPTER 45 OF THE CODE OF
THE CITY OF MIAMI BEACH, FLORIDA, BY INCREASING
SCHEDULE OF RATES FOR WATER SUPPLY SERVICE TO
MUNICIPALITIES AND TO NON-MUNICIPAL CONSUMERS
OF WATER; INCREASING MINIMUM MONTHLY SERVICE
CHARGES; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Sections 45. 4 (a) and (b) of the Code of the City
of Miami Beach reading as follows :
" (a) The meter rate to non-municipal consumers for water
supply service in the territory shall be 480 per 1, 000
gallons. "
" (b) Any municipality which purchases its water supply
in whole or in part from the City shall be charged at
the rate of 480 per 1, 000 gallons. "
be and the same is hereby amended to read as follows:
" (a) The meter rate to non-municipal consumers for water
supply service in the territory shall be 530 per 1, 000
gallons. "
" (b) Any municipality which purchases its water supply
in whole or in part from the City shall be charged at
the rate of 570 per 1, 000 gallons. "
The provisions of said paragraph " (b) " in this Section shall abide
the event of current litigation in the Florida Supreme Court and the
Third District Court of Appeal, and in the Dade County Circuit Court,
Case No. 78-15262, now pending.
SECTION 2 : That Section 45. 4 (c) of the Code of the City of Miami
Beach reading as follows :
" (c) The water rate of 480 per 1, 000 gallons as set
forth in paragraphs (a) and (b) hereinabove, is to be
applied to all water billings based on meter readings
taken on or after November 1, 1975. "
be and the same is hereby amended to read as follows:
" (c) The water rate of 530 per 1, 000 gallons for
non-municipal consumers as set forth in paragraph (a) ;
and the water rate of 570 per 1, 000 gallons for any
municipality which purchases its water supply in whole
or in part from the City as set forth in paragraph (b)
hereinabove, is to be applied to all water billings
based on meter readings taken on or after November 1,
1978 . "
