AN ORDINANCE OF THE CITY OF MIAMI BEACH REPEALING
ORDINANCE NO. 78-2137 , PURSUANT TO LITIGATION
PENDING IN DADE COUNTY CIRCUIT COURT, CASE
NO. 78-15262 , AND PROVIDING FOR ADOPTION AS AN
EMERGENCY MEASURE.
WHEREAS, by Order entered by Dade County Circuit Court in
Case No. 78-15262 , dated November 6, 1978 , the City Commission is
required, under penalty, to repeal and rescind Ordinance No. 78-2137 ;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1 : That Ordinance No. 78-2137 of the City of Miami Beach
be and the same is hereby repealed and rescinded.
SECTION 2 : That the City Commission of the City of Miami Beach
having found and determined that a public emergency
exists affecting life, health, property or public safety, this
Ordinance is hereby adopted as ,an emergency measure and shall go
into effect immediately upon its adoption.
