WHEREAS, on February 12, 1993, the Mayor and City Commission adopted Resolution No. 93-20721, accepting and adopting the City Center Historic Convention Village Redevelopment and Revitalization Plan (Redevelopment Plan), in accordance with Sections 163.360, Florida Statutes; and WHEREAS, Section 163.361, Florida Statutes, provides that any time after the approval of a community redevelopment plan by the governing body, it becomes necessary or desirable to amend or modify such plan, the governing body may amend such plan upon recommendation of the Redevelopment Agency; and WHEREAS; the Miami Beach Redevelopment Agency (RDA), believes it is necessary to amend the Redevelopment Plan in order to reflect existing conditions and future plans for the City Center Area, as contemplated within the Preliminary Proposed Master Plan for the 1 ih Street Surface Lots, prepared by Zyscovich, Inc., dated September 21, 2001, which was adopted, in concept, by the Mayor and City Commission on October 17, 2001; and WHEREAS, recent changes to Chapter 163.361, Florida Statutes, enable community redevelopment areas, to implement and fund "community policing innovations", defined as a "policing technique or strategy designed to reduce crime by reducing opportunities for and increasing the perceived risks of engaging in, criminal activity through visible presence of police in the community, including but not limited to, community mobilization, neighborhood block watch, citizen patrol, citizen contact patrol, foot patrol, neighborhood storefront police stations, field interrogation, or intensified motorized patrol"; and WHEREAS, the RDA believes it is necessary to amend the Redevelopment Plan to include a community policing innovation program, which will provide an opportunity for the RDA to shoulder the cost for current and enhanced levels of police services within the City Center boundaries; and WHEREAS, in response to a significant increase in the City's office vacancy rate, the City Commission requested that the Administration evaluate the development of a Business Assistance Program; and WHEREAS, staff has been developing such a program which provides up to a maximum of $3,000 in direct cash incentives for each new job created; and WHEREAS, since the City Center Redevelopment Area contains approximately 55 percent of the City's existing and future office space supply, of which 21.7 percent is projected to be vacant; and WH EREAS, the RDA Administration is currently researching Chapter 163, Florida Statutes, and determine if tax increment funding may be used to participate in the funding of the Assistance Program; and WHEREAS, pursuant to Section 163.361, Florida Statutes, in order to proceed with amending the Redevelopment Plan, the City Commission must hold a public hearing. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a Public Hearing is set for Wednesday, May 29,2002, at 10:00 A.M., during the regularly scheduled meeting of the Miami Beach Redevelopment Agency (RDA), in accordance with Chapter 163.361, Florida Statutes, to consider adopting a Resolution ofthe Chairman and Members of the Miami Beach Redevelopment Agency (RDA), recommending approval of amendments to the City Center Historic Convention Village Redevelopment and Revitalization Area Plan, an approved Redevelopment Plan under the provisions of Sections 163.360, Florida Statutes; said Amendments A) providing that the Plan incorporate, by reference, the Preliminary Proposed Master Plan for the 1 ih Street Surface Lots, prepared by Zyscovich, Inc., dated September 21 ,2001; B) developing and implementing community policing innovations within the district, as provided for in sections 163.340, 163.350, 163.356, 163.360, 163.361, and 163.370, Florida Statutes; and C) participating in the Miami Beach Business Assistance Program for the purpose of business recruitment and retention within the Redevelopment Area; said Public Hearing to be held in the City Commission Chambers at 1700 Convention Center Drive, Miami Beach, Florida; and the City Clerk is hereby authorized and directed to publish and distribute the appropriate public notice of said public hearing at which time and place all interested parties will be heard. Issue: Section 163.361, Florida Statutes, provides that the "governing body" of the Redevelopment Agency may amend the Redevelopment Plan from time to time, upon recommendation of the Agency. The Administration believes it is opportune to amend the City Center/Historic Convention Village Redevelopment Area Plan in order to reflect existing conditions and future plans for the area, as contemplated in the Preliminary Proposed Master Plan submitted by Zyscovich, Inc., accepted in concept by the City Commission on October 17, 2001. The Administration is also recommending to amend the Redevelopment Plan to take advantage of recent changes to Chapter 163, Florida Statutes, which allow redevelopment agencies to implement and fund "Community Policing Innovations" in redevelopment areas. The Program is anticipated to go into effect during FY 2002/03. Additionally. since City Center contains 55 percent of the City's existing and future office supply, of which 21.7 percent is projected to be vacant, the RDA is seeking a final determination from the City Attorney as to whether Tax Increment funds, to the extent they are available, may be used to participate in the City's proposed Business Assistance Program. Subject to the adoption of the proposed Amendment by the City Commission, the adopted Amendment must then be presented to Miami-Dade County's Community Redevelopment Agency (CRA) Committee for consideration and recommendation to the Board of County Commissioners, which in turn must hold a Public Hearing prior to adopting the proposed Amendment. As such, the Administration recommends scheduling the Public Hearing, as a first step in the process of implementing the proposed enhancements to the City Center Redevelopment Plan. ANALYSIS Section 163.361, Florida Statutes, provides that the "governing body" of the Redevelopment Agency may amend the Redevelopment Plan from time to time, upon recommendation of the Agency. The Administration believes it is opportune to amend the City Center/Historic Convention Village Redevelopment Area Plan in order to reflect existing conditions and future plans for the area as contemplated by the master planning initiative underway by Zyscovich, Inc., and most importantly, to take advantage of a provision under Section 163.361, Florida Statutes, to implement and fund Community Policing Innovations in the area. Commission Memorandum Amendment to City Center Redevelopment Plan May 8, 2002 Page 2 of 3 Redevelopment Plan Update On April 18, 2001, the City Commission authorized the Administration to enter into contract with Zyscovich, Inc., (Consultant), to develop a concept plan for the 1 ih Street and Washington Avenue surface parking lots, incorporating the proposed expansion of the New World Symphony (NWS). Due to the significance of this site and the impact of future development alternatives contemplated thereon, the Consultant's scope was expanded to evaluate the site in the context of its importance to the surrounding core area of the City and to develop an updated Master Plan for City Center/Historic Convention Village Redevelopment Area in the process. On September 21,2001, Zyscovich, Inc., delivered a site utilization report and preliminary concept plan, entitled "Preliminary Proposed Master Plan, that addresses the needs of the Convention Center and the New World Symphony, evaluates parking and transportation requirements, respects the need for an open space public plaza, identifies opportunities for gateway entrance features, evaluates the need and location of an Intermodal Center, and complements the adjacent urban relationships and historic districts. The Plan was approved in concept by the City Commission at the October 17, 2001 Commission Meeting. This preliminary concept plan not only reflects updated conditions in the area since the inception of the original City Center Redevelopment Plan in 1993, but also continues to provide as a working document to finalize outstanding urban planning issues essential to the completion of the Plan. These issues, which are being addressed by Zyscovich, as part of its ongoing scope of services, include streetscape improvements for Convention Center Drive; streetscape improvements for 16th Street east-west corridor; potential re-zoning of 1 ih Street; analysis of the 215t Street Community Center and establishment of Dade Boulevard Traffic Circles; determining the location and phasing of a garage and charging facility for the Electric Shuttle; the development of the preferred lots to address specialized meeting/exhibition space and parking requirements for the Convention Center; the short and long term plans for the location and development of the Garden Center; site development analyses relative to the New World Symphony expansion plans; concept plan development for Pennsylvania Avenue garage fa(fade retail; resolution of Drexel Avenue closing; Lincoln Road streetscape issues; and, streetscape design changes related to the bus route changes. As such, the Administration recommends adopting an amendment to the City Center Redevelopment Plan, incorporating by reference the Preliminary Proposed Master Plan for 1 ih Street Surface Lots and surrounding Convention/Civic Center Area. Community Policing Innovations: Recent changes to Chapter 163.361, Florida Statutes, enable Community Redevelopment Areas (CRAs), to implement and fund "community policing innovations", defined as a "policing technique or strategy designed to reduce crime by reducing opportunities for and Commission Memorandum Amendment to City Center Redevelopment Plan May 8, 2002 Page 3 of 3 increasing the perceived risks of engaging in, criminal activity through visible presence of police in the community, including but not limited to, community mobilization, neighborhood block watch, citizen patrol, citizen contact patrol, foot patrol, neighborhood storefront police stations, field interrogation, or intensified motorized patrol." This provision in the State Statutes presents an opportunity for the RDA to shoulder the cost for current and enhanced levels of police services within the boundaries of the City Center area, providing the potential for significant savings to the General Fund. In accordance with Section 163.350, the RDA has been working with the Police Department to draft a "workable program," which the City Administration is in the process of evaluating as part of the FY 2002/03 Budget process. Miami Beach Assistance Program The City's office market has experienced significant, rapid shifts in the late 1990's, fueled by the expansion of the entertainment and new media industry. However, due to factors beyond the City's control (the dot-com collapse, nationwide recession, softening of the South Florida office market), the City currently faces a 25% office vacancy rate. The vacancy rates will undoubtedly affect property assessment values. On February 20, 2002, the Mayor and City Commission referred a discussion relative to LNR Property Corporation's relocation to the Finance and Citywide Capital Projects Committee meeting. The Commission requested that the Administration evaluate the development of a Business Assistance Program. Staff has since been developing such a program which provides up to a maximum of $3,000 in direct cash incentives for each new job created. Eligibility for the incentives will be based on certain scoring criteria, for which applications will be assigned points. The amount of the incentive will vary according to the number of points received. A full description of the proposed Program is attached this memorandum. Since the City Center Redevelopment Area contains approximately 55 percent of the City's existing and future office space supply, of which 21.7 percent is projected to be vacant, the Administration has researched Chapter 163, Florida Statutes, to determine if Tax Increment Funds may be used to participate in the funding of the Assistance Program. Pursuant to a preliminary determination by David Cardwell, General Counsel, Florida Redevelopment Association, the RDA may in fact participate in the Program, to the extent that the City Center Redevelopment Plan allows for it and to the extent that funds are available. The City Attorney is expected to render a final opinion as to RDA's ability to participate in the Program and whether the language in the Redevelopment Plan needs to be amended in order to do so. If a business has difficulty accessing any of these programs, the City of Miami Beach may offer local assistance in the forms of grants, reduced fees, permit waivers or rebate, or special enhancement projects. The City of Miami Beach will prepare an incentive package proposal to offer eligible projects, based on the availability of City resources. A prospective company's adoption of the City of Miami Beach's living wage, domestic partnerships and human rights policies will be considered as additional criteria regarding demonstrated benefits for the relocation to Miami Beach. Apply to all applicable programs listed above (5 points); 2. Be in a targeted industry (5 points); 3. Demonstrate that incentives are necessary for the business to locate or expand in Miami Beach (5 points); 4. Pay an average wage that is at least 115% ($34,452) of the average wage of the Metropolitan Statistical Area (10 points); 5. Create a minimum of 50 new jobs in Miami Beach (25 points); 6. Show that the jobs make a significant economic contribution to the area economy (5 points); 7. Lease a minimum of 7,500 square feet (10 points); 8. Demonstrate strong commitment with at least 10 years contractually committed to the lease (or ownership) (10 points); 9. Commit to compliance with City of Miami Beach ordinances and State of Florida Building Codes (5 points); 10. Have a minimum net worth of $1 million and annual sales of at least $2.5 million, or, have a minimum net worth of $1 million and have been in business for a minimum offive (5) years (10 points); 11. Enter into a "First Source Hiring Agreement" with the City (5 points); 12. Demonstrate the ability of the project to enhance the local tax base (5 points). *Incentive amounts will be a maximum of $3,000 per new job created, and will be paid out over a period of five (5) years. The maximum amount that will be paid out in anyone-year period is $2 per square foot of leased space. Any remaining amount above $2 per square foot will be paid out during the years following the initial five-year payout period, subject to approval of the City of Miami Beach. Item numbers 5, 6, 8, 9, and 11 must be documented in writing and are subject to verification by the City. Businesses that participate in the Miami Beach Business Assistance Program will be required to submit employment and payroll reports on an annual basis to the City for verification of the number of jobs that were created and retained during that period. Any reduction in jobs will result in a proportionate reduction in the incentive amount. Qualified Target Industry Program This program provides an incentive for target industries to locate new business in Florida. The program provides tax refunds of $3,000 ($5,000 in an enterprise zone) per new job created. For a new business, at least ten new jobs must be created (10% increase for expansion projects), and the business must pay at least 115 percent of the average wage. Significant economic impact must be demonstrated by the project. Quick Response Training Program This is a customer driven training program designed as an inducement to secure new businesses to Florida as well as provide existing businesses the necessary training for expansion. Road Fund This is an incentive tool designed to alleviate transportation problems that adversely impact a specific company's location or expansion decision. The elimination of the problem must serve as an inducement for a specific company's location, retention, or expansion project and must create or retain job opportunities. Enterprise Zone The enterprise zone is an area targeted for economic revitalization, and offers financial incentives to businesses located in designated areas found in urban and rural communities. These incentives are offered to encourage private investment in the zones as well as employment opportunities for area residents. Incentives include: a jobs tax credit, property tax credit, sales tax refunds, and property tax abatements. Historic Property Tax Abatement (County) This program allows for the 10-year abatement of the County's ad valorem taxes on the value of improvements made to historic properties. Historic Preservation Tax Credits This federal program provides Federal Tax Credits of 10% and 20% for the renovation of historic properties, provided that they meet certain preservation guidelines.
