Ordinance 73-1971 ORDINANCE NO. 73-1971
AN ORDINANCE AMENDING ORDINANCE NO. 1891, BEING
THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY
OF MIAMI BEACH, FLORIDA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 6-9 B. 15 of Ordinance No. 1891, being
the Comprehensive Zoning Ordinance of the City of
Miami Beach, Florida., be and the same is hereby amended to read
as follows :
"15 . The following uses may be permitted as a
Conditional Use :
a. Uses not listed above which are similar in
character to one or more permitted uses, and
which would not be inappropriate in this
District.
b. Public and governmental buildings and uses .
c. Publicly owned and operated recreational
facility, :playground, playfield, park and
beach.
d. Public utilities or public service uses ,
structures and appurtenances .
e. Sidewalk cafes in districts authorizing such
use, and further subject to: (1) prior
findings and determinations by the City Council
that such permitted sidewalk cafes will not
constitute or create unreasonable obstructions
to the prior and paramount right of the public
for passage upon the public ways , and provided
(2) that such sidewalk cafe shall be
appurtenant to and constitute an integral
part of a substantial, bona fide restaurant
situate in a building abutting directly and
immediately upon that portion of the public
way upon which the sidewalk cafe shall be
operated and conducted, and (3) a suitable
and appropriate plan or sketch showing the
proposed location of said sidewalk cafe in
relationship to the main restaurant required
hereby, and the proposed seating arrangement
to be utilized by said sidewalk cafe shall be
submitted to the Planning Board and the City
Council for approval prior to the issuance of
any permit for such sidewalk cafe .
f. Temporary use for a period not to exceed 15 days . "
SECTION 2 . That that portion of the Lincoln Road Mall lying between
the westerly line of Washington Avenue and the easterly
line of Alton Road be and the same is hereby designated as a "side-
walk cafe district, " and the maps attached to and made a part of said
Ordinance No. 1891 be and the same are hereby amended to show such
"sidewalk cafe district" .

SECTION 3 . All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 4. This ordinance shall go into effect immediately
upon its passage and posting as required by law.
