95-21654 Reso . , RESOLUTION NO. 95-21654 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING FOR A PUBLIC HEARING, PURSUANT TO ORDINANCE NO. 91-2742, TO CONSIDER RAISING THE FRANCHISE FEE PAID TO THE CITY BY PRIVATE WASTE CONTRACTORS FROM THE CURRENT FEE OF TEN PERCENT (10%) OF THE FRANCHISEE'S TOTAL MONTHLY GROSS RECEIPTS FOR WASTE REMOVAL IN THE CITY, TO TWELVE PERCENT (12%) OF RECEIPTS. WHEREAS, pursuant to Ordinance No. 91-2742, enacted on April 24, 1991, the Mayor and City Commission are authorized to adopt a resolution once yearly raising the amount of the franchise fee paid to the City by private waste contractors by up to two percent (2%); and WHEREAS, the Administration has recommended that the franchise fee be raised from the current fee often percent (10%) of the franchisee's total gross receipts for waste removal within the City of Miami Beach, to a fee of twelve percent (12%) of receipts, the raise to be effective on October 1, 1995; and WHEREAS, to consider the recommendation of the Administration, Ordinance No. 91-2742 requires that a public hearing be scheduled to receive public input regarding this matter. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that a public hearing to consider raising the franchise fee paid to the City by private waste contractors, from ten percent (10%) of the franchisee's total monthly gross receipts fOF waste removal in the City, to twelve percent (12%) of receipts, is hereby called to be held before the City Commission in its chambers on the Third Floor of City Hall, 1700 Convention Center Drive, Miami Beach, Florida on September 13,1995, beginning at 4:30 p.m.; and the City Clerk is hereby authorized and directed to publish appropriate Public Notice of the said Public Hearing in a newspaper of general paid circulation in the City of Miami Beach, at which time and place all interested parties may be heard. SUB.JECT: ADMINISTRA TION RECOMMENDATION: The Administration recommends that the City Commission approve the resolution calling for a public hearing pursuant to Ordinance No, 91-2742 to consider raising the Franchise Fee paid to the City by private waste haulers from the current ten percent (10%) to twelve percent (12%) of the franchisee's total montWy gross receipts. BACKGROUND Under Chapter 14A of the Miami Beach City Code, Section 14A-16 provides for regulations, fees, and procedures, and specifies that the City has the option of raising the Franchise Fee once yearly, said raises not to exceed two percent and shall be imposed only by resolution after a public hearing and thirty days prior notice to all Franchise Waste Contractors. The last such increase was effective on October 3, 1992. It is proposed that a public hearing be held on the regular Commission Meeting of September 13, 1995, and that public notices be sent the week of August 14, 1995. ANALYSIS The proposed Franchise Fee increase from ten percent (10%) to twelve percent (12%) will generate an additional estimated revenue of$180,000.00 per year.
