Ordinance 74-1991 ORDINANCE NO. 74-1991
AN ORDINANCE AMENDING ZONING ORDINANCE
NO. 1891, SO AS TO PERMIT SWIMMING POOL
DECKS TO EXTEND TO REAR PROPERTY LINES
WHEN ABUTTING CANALS , AND INCREASING
SIDE YARD SETBACKS .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 8-1 (B) 6a. of Ordinance No. 1891, being
the Comprehensive Zoning Ordinance of the City of
Miami Beach, be and the same is hereby amended to read as
follows :
"a . Rear Yard Setback
6 ft. minimum setback from rear property
line to pool deck or platform, or screen
enclosure associated or not associated
with a pool, provided, however, that pool
decks may extend to the rear property
line when abutting upon any bay or canal. "
SECTION 2 . That Section 6-1 (E) 2 of said Ordinance No. 1891,
be and the same is hereby amended to read as
follows :
"2 . Side : The sum of the side yardwidth
shall be at least 25% of the lot width
but no side yard adjacent to a street
shall be less than 15 ft. and no
interior side yard shall be less than
7.5 ft. except that where an existing
building has a 5 ft. side yardsetback
be allowed to follow the existing
building line for an addition to said
building. "
SECTION 3 . All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 4. This ordinance shall go into effect immediately
upon passage and posting as required by law.
