AN ORDINANCE AMENDING CHAPTER 45 OF THE
CODE OF THE CITY OF MIAMI BEACH PROHIBITING
THE SALE OF WATER TO ANY OTHER MUNICIPALITY
EXCEPT PURSUANT TO WRITTEN CONTRACT
RECOMMENDED BY THE CITY MANAGER AND APPROVED
BY THE CITY COUNCIL; PROVIDING FOR THE ADOPTION
HEREOF AS AN EMERGENCY MEASURE; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1 . That Section 45-4 (b) of Chapter 45 of the Code of
the City of Miami Beach be and the same is hereby
amended to read as follows :
" (b) From and after the 1st day of
October , 1974 , no water shall
be sold or delivered by the City of Miami
Beach to any other municipal corporation
except pursuant to' a written contract at
rates and upon terms and conditions
recommended by the City Manager and
approved by the City Council. "
SECTION 2. That Paragraph (c) of Section 45-4 be and the same
is hereby deleted, and the remaining paragraphs in
said Section 45-4 are re-lettered in order to conform to such
deletion.
SECTION 3. All ordinances in conflict herewith be and the same
are hereby repealed.
SECTION 4. This Ordinance is adopted as an emergency measure
pursuant to the provisions of Section 9 of the Charter
of the City of Miami Beach, in order to meet a public emergency
affecting life, health, property, and public safety, and shall
be effective October 1, 1974 .

having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door of the
City Hall in said City on the 6th day of September, 1974
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
