Ordinance 74-2006 ORDINANCE NO. 74-2006 AN ORDINANCE AMENDING CHAPTER 18 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, EXEMPTING THE CITY FROM THE REQUIREMENTS OF SECTION 18 . 6 . 1 (e) , AND ADOPTING THE SAME AS AN EMERGENCY MEASURE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA : SECTION 1. That that portion of Section 18.6 . 1 reading as follows : " (e)A vendor licensed under subsection (g) or sub- section (h) of section 18-8 may, by and with the consent of the city manager first had and obtained, transfer the license of such vendor to a new lo- cation; provided, that such new location shall not be more than three hundred feet from the location for which such license was issued, such distance to be measured in an air line from main entrance to main entrance; provided, however, that if the existing location has been acquired by any governmental entity through eminent domain pro- ceedings, such new location may be more than three hundred feet from the location for which such license was issued subject to the approval of the city manager and ratified and confirmed by the city council. Before any license shall be transferred, as provi- ded in this section, there shall be paid to the city clerk an amount equal to one-seventh of the annual license fee provided in section 18-8 for such license. SECTION 3 . That the City Council of the City of Miami Beach, Florida, having found and determined that a public emergency exists affecting life, health, property or public safety, this Ordinance is hereby adopted as an emergency measure, pursuant to the provisions of Section 9 of the Charter of the City of Miami Beach, Florida, and shall go into effect immediately.
