AN ORDINANCE GUARANTEEING THAT EQUALITY OF
RIGHTS WITHIN THE CITY OF MIAMI BEACH SHALL
NOT BE DENIED OR ABRIDGED ON ACCOUNT OF SEX.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1 Section 25-38.9, Miami Beach City Code is hereby
added to read as follows:
Sec. 25-38.9 Equality of Rights
(1) Equal Rights. Equality of rights shall not be de-
nied or abridged on account of sex by any public or
private person or entity within the City of Miami
Beach. Gender-based discrimination founded solely
on moral and religious grounds shall be exempt from
this section.
(2) Criminal & Civil Enforcement. Violations of this
law shall be prosecuted by the Miami Beach Munici-
pal Prosecutor, and subject to fine and jail sen-
tence not exceeding $500 and fourteen days, res-
pectively. Any person injured by a violation of
this law may bring a civil action and shall be
awarded punitive damages and attorneys fees in
appropriate cases.
SECTION 2 EFFECTIVE DATE. This Ordinance shall take effect
90 days after its passage by the City Commission.
SECTION 3
INCONSISTENCIES. This Ordinance shall repeal any
provision in any other City Ordinance inconsistent
herewith.
SECTION 4 SEVERABILITY. If any Section, subsection, sen-
tence, clause, phrase, or portion of this Ordinance is, for any
reason, held ineffective, invalid or unconstitutional by any
court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding
shall not affect the validity of the remaining portions of this
Ordinance.
