AN ORDINANCE AMENDING ORDINANCE NO. 1901,
AS AMENDED, THE SAME BEING AN ORDINANCE
PROVIDING FOR THE CREATION AND MAINTENANCE
OF THE RETIREMENT SYSTEM FOR GENERAL
EMPLOYEES AND ELECTED OFFICIALS OF THE
CITY OF MIAMI BEACH, FLORIDA, BY ADDING
PROVISIONS RELATING TO COST OF LIVING
INCREASES IN PENSION OR RETIREMENT
ALLOWANCES, REPEALING ALL ORDINANCES IN
CONFLICT, PROVIDING A SEVERABILITY CLAUSE
AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 5.09 of Ordinance No. 1901, as amended,
of the City of Miami Beach, Florida, be and the same
is hereby amended by adding new paragraphs thereto following
subsection (e) to be lettered and to read as follows:

who retired prior to January 1, 1979, on
normal retirement or early service retire-
ment allowances shall receive a cost of
living increase payable monthly based on
the Retirant's year of retirement and the
original retirement allowance payable at
the time of such retirement as set forth

(g)(1) Effective April 1, 1980, Disability
Retirants who retired prior to January 1, 1979,
and who continue to be entitled to receive
a disability retirement allowance in accor-
dance with the provisions of this ordinance
shall receive a cost of living increase pay-
able monthly based on the Disability Retirant's
year of retirement and the original disability
retirement allowance payable at the time of
such retirement as set forth as follows:

However, any such Disability Retirant, upon reaching
normal retirement date, shall have his or her cost of living
increase recomputed based upon his or her year of disability
retirement and the normal retirement allowance, unadjusted by
any prior improvement factor or cost of living increases, pay-
able on such normal retirement date as set forth as follows:

2. Effective April 1, 1980, any Disability Retirant who
retired prior to January 1, 1979, and who reached normal retirement
date prior to April 1, 1980, shall receive a cost of living increase
payable monthly based upon the Disability Retirant's year of dis-
ability retirement and the normal retirement allowance, unadjusted by
prior improvement factor or cost of living increases, payable on such
normal retirement date as set forth as follows:

Nothing herein shall be construed so as to grant a
cost of living increase to a Member who applied for a vested
retirement allowance prior to January 1, 1979, but whose retire-
ment allowance payments did not commence prior to January 1,
1979."
SECTION 2: That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby
repealed.
SECTION 3: In the event any article, section, paragraph,
sentence, clause or phrase of this Ordinance shall
be adjudicated invalid or unconstitutional, such adjudication
shall in no manner affect the other articles, sections, para-
graphs, sentences, clauses or phrases of this Ordinance, which
shall be and remain in full force and effect as fully as if the
item so adjudged invalid or unconstitutional was not originally
a part hereof.
SECTION 4: This Ordinance shall go into effect upon its passage
in accordance with law.
