RESOLUTION NO. 1591
BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA:
1. That that alley shown through Blocks Nineteen
and Twenty-three as shown on an amended map of the Ocean
Front Property of the Miami Beach Improvement Company, re.,#
corded in Plat Book 5, at pages 7 and 8, of the Public
Records in the office of the Clerk of the Circuit Court of
Dade County, Florida, which alley lies parallel with Collins
Avenue as shown on said plat, be and it, the said alley,
is hereby vacated and discontinued in each of said blocks.
2. That this resolution shall be and continue
effective only when the owner or owners of the entire of said
blocks shall execute, acknowledge and deliver to this City,
in such form as shall be approved by its City Attorney,
G. E. McCaskill , endorsed thereon, an instrument in writing
granting to this City an easement or right in and over which
this City, or any of its grantees of franchises, may construct
and maintain sewers, drains , pipes, conduits, poles or wires
for providing or distributing sewage, water, gas, light, power
or any other service, which easement shall be exercised by
this City in the place where said alley is now dedicated only
when the present owner or owners, or his, her or their heirs
or assigns, shall hereafter lease or convey title to Lot Two
of said Block Nineteen or Lots Two and Tree of said Block
Twenty-three, without a lease or sale to the same person of
a contiguous lot bordering on a public highway, as shown on
said plat, and when such lessee or grantee shall request any
of said services then such easement or right shall be exercised
only as to the block a part of which has been leased or conveyed
as aforesaid.
