Ordinance 81-2255s ORDINANCE NO. 81-2255 AN ORDINANCE AMENDING CHAPTER 14 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, RELATING TO FIRE PREVENTION; BY REVISING SECTION 14-74 TO PROVIDE THAT VIOLATIONS OF ANY OF THE PRO- VISIONS OF THE FIRE PREVENTION AND SAFETY CODE SHALL BE TRIED IN THE COUNTY COURT; BY ADDING A NEW SECTION THERETO REQUIRING AN ANNUAL IN- SPECTION OF FIRE ALARM AND DETECTION SYSTEMS; REPEALING ALL ORDINANCES IN CONFLICT; PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That Section 14-74 of the Code of the City of Miami Beach, Florida, is hereby amended to read as follows: "Sec. 14-74. Penalties for violation. All persons charged with a violation of any of the provisions of the Fire Prevention and Safety Code of the city shall be tried in the munlelpal county court and, if convicted, shall be punished by fine, not ex- ceeding one thousand dollars, or by imprisonment in the ety county jail, or by both such fine and impris- onment." SECTION 2: That Chapter 14 of the Code of the City of Miami Beach, Florida, is hereby amended by adding thereto a new section to be designated 14-75, which shall immediately follow Section 14-74.1 and shall read as follows: Sec. 14-75. Annual Inspection of Fire Alarm and Detection Systems. It shall be the responsibility of the owner/agent or occupant of the premises having a fire alarm system, a fire detection system or a fire sprinkler system to have such systems maintained. The system shall be inspected on an annual basis, as a minimum, to determine that such systems are operating correctly. A tag or sticker shall be placed on the system by the contractor or company performing the in- spection certifying the date of the inspection and that the system is operating properly. Fire alarm specialty electrical contractors or electrical contractors certi- fied by Metropolitan -Dade County or by the State of Florida, are authorized to conduct such tests and in- spections on fire alarm or fire detection systems. Fire sprinkler systems shall be tested by duly licensed sprinkler companies authorized to service and repair said systems by Metropolitan Dade County or the State of Florida. A Fire Systems Report, as prescribed by the Chief of the Fire Prevention Bureau, or a copy of a maintenance contract covering the details of the test, operation and efficiency of the system, shall be maintained on the premises and available for review by the Miami Beach Fire Department at all times.
