AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING CHAPT.8 of
THE CODE BY THE ADDITION OF A NEW SECTION 8-4, PROVIDING
FOR TEMPORARY STRUCTURES UNDER CERTAIN CONDITIONS, PROVIDING
FOR SEVERABILITY AND REPEALING ALL ORDINANCES IN CONFLICT
THEREWITH:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA:
Section 1: That Chapter 8 of the Code of the City of Miami Beach, Florida
be amended by the adoption of a new Section 8-4 reading as follows:
SECTION 8-4: TEMPORARY STRUCTURES
Notwithstanding any provision of the Zoning Ordinance, a
temporary structure used for the sale or rental of real
estate or as construction offices shall be permitted in
conjunction with the construction of a building for which
a valid building permit has been issued, subject to the
following:
(1) The use of the temporary structure shall
relate directly to the building for which
a valid building permit has been issued.
(2) The temporary structure shall be located
on the same lot as the building to which it
relates or on a lot within 400' of the lot
to which it relates.
(3) The temporary structure shall be permitted
only after issuance of a building permit for
the building to which the temporary structure
relates, and such temporary structure shall be
removed upon issuance of a Certificate of
Occupancy for such building, or within 30 days
after the building permit for such building
expires, whichever comes first.
(4) Prior to approval of the temporary structure
by the Building Official a $2000 cash bond shall
be placed on deposit with the City to assure
removal of such structure in accordance with the
provisions stated herein.
Section 2: REPEALER: All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
Section 3: SEVERABILITY: If any section, sub -section, sentence, clause,
phrase, or portion of this Ordinance is, for any reason, held
invalid or unconstitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and such holding
shall not affect the validity of the remaining portions of this Ordinance.
Section 4: This Ordinance shall become effective upon its passage in
accordance with law.
