Resolution 1680 r mam mew len RESOLUTION NO. 1680 WHEREAS, a resolution was passed and adopted by the City Council of the City of Miami Beach, Florida, on August 17th, 1927, requiring the owners of real property within the City of Miami Beach, Florida, to clear the same of and destroy weeds, undergrowth, rubbish, debris, trash and unsightly and unsanitary matter on or before October' 27th, 1927, and WHEREAS, due notice was given to such property owners by publica, tion in two consecutive issues of the Miami Beach Beacon, a newspaper published in said City, in accordance with the provisions of the afore- mentioned resolution of said City Council, and WHEREAS, the premises known as Lot 4, Block 73 of Lincoln Subdi- vision in the City of Miami Beach is encumbered with a large amount of weeds, undergrowth, rubbish, debris, trash and unsightly and unsanitary matter and it is hereby declared that the .condition of said premises constitutesa menace to the health, convenience and welfare of the citizens of said City , and WHEREAS, the owner of said Lot 4, Block 73 of Lincoln Subdivision a-p has failed to comply with the terms and requirements of said resolution and said premises have continued and now remain in the same unsightly, unsanitary and harmful condition, and WHEREAS, it appears to this City Council, from a communication received by it from the head of the Fire Department of this City that said premises are a dangerous menace to the City of Miami Beach, because of certain rubbish, debris and a certain dwelling house, situated thereon, which has large openings in its facade and walls; and from a communication to this City Council from the head of the Health Depart- ment of this City, that said premises axe a menace and danger to the health, safety and welfare of the City of Miami Beach because of their said present condition and particularly because of the unsanitary con- dition existing in said open dwelling house; and this City Council having received communications and complaints from owners of property adjacent to and situated near said premises to the effect that their health morals and safety are impp4red and endangered and thelli propert y endangered because of said condition of said premises. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA:* Section 1. That the City Manager of the City of Miami Beach, Florida, is hereby directed and authorized to proceed and cause such work to be done as may be reasonably necessary to remove from said pre- __ mises the unsightly and unsanitary condition thereof and to clear the same of all rubbish and. debris, and to make the same reasonably safe from fire, and cease to be a health menace to the community, and to close the dwelling house, on said premises , securely blockading all doors, windows, holes, or openings therein, and likewise, treat such other structures or out-houses as may be situated thereon, to keep an account of such work and resort the same to the Council , whereupon the costs thereof shall be made a charge and lien against the property so cleared and preserved, of the same extent and character as liens for special assessments provided for in the charter of this City.
