Ordinance 81-2284ORDINANCE NO, 81-2284 AN EMERGENCY ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA RESTRICTING COMMERCIAL SOLICITING WITHIN THE CITY OF MIAMI BEACH. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 LEGISLATIVE PURPOSE The City Commission finds that commercial peddling and soliciting, including particularly the solicitation of transportation or other services on behalf of, and in exchange for commissions or fees from retail merchants, involves elements of unfair competition, consumer overreaching, and misrepresentation. Such activities have become widespread and virtually uncontrolled within the City and endanger the reputation, safety and welfare of the City and its residents and visitors. This ordinance is adopted as an emergency and temporary measure to control such activities, pending further study by the City Commission, City Manager, Police Chief and City Attorney. SECTION 2 PROHIBITION It shall be unlawful for any person in consideration for direct or indirect commission, fee or other pecuniary gain, to request, urge or solicit any other person on any City street or sidewalk, or in or around any City hotel, restaurant or other facility or area commonly accessible to the public, to purchase any item or patronize any shop, restaurant, hotel or retail establishment unless said commis- sion, fee, or other pecuniary interest is expressly disclosed to the person solicited, provided however that this section shall be limited to oral person-to-person communications and shall not in- clude telephonic, radio, television or other electronic solicita- tions. SECTION 3 OTHER LAWS This ordinance shall be in addition to any and all other State and local laws. SECTION 4 VIOLATIONS Any person violating this ordinance shall be arrested, and if con- victed, fined $500 for the first offense, $1,500 for the second offense, and $5,000 for the third and subsequent offenses. SECTION 5 EFFECTIVE AND TERMINATION DATES This ordinance is enacted as an emergency measure to protect the health, welfare and safety of residents and visitors within the City of Miami Beach, shall take effect immediately, and shall expire on February 1, 1982.
