AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA AMENDING CHAPTER 2 OF
THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA,
DEFINING THE TERMS OF OFFICE OF ALL CITY BOARD
AND COMMITTEE MEMBERS BY ADDING NEW SECTION 2-
1.3.1.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1:
Chapter 2 of the Code of the City of Miami Beach be and the same is
hereby amended by adding Section 2-1.3.1 as follows:
Sec.2-1.3.1. Board & Commission Members - Termination of
Office.
(A) Expiration of terms: All persons serving on City
Boards, Committees, Commissions or Authorities shall
cease to hold office when a successor is duly appointed,
or 60 days after expiration of the term of their office
(as said term is specified in the ordinance, resolution
or other law creating said office) whether or not a suc-
cessor has been appointed, whichever occurs first, and
such persons shall at that time cease to exercise any
rights, power or prerogatives of office.
(B) Current members: Any person whose term expired
prior to adoption of this ordinance shall cease to hold
office 60 days after adoption of this ordinance, or when
replaced, whichever occurs first.
(C) Exceptions: This ordinance shall not apply to per-
sons appointed to serve for a specified term "and until a
successor is appointed" (or words to that effect); such
persons shall continue to serve until reappointed or a
successor is appointed by the City Commission. This or-
dinance shall not apply to any Board, Committee, Commis-
sion or Authority required by Federal, State or County
law.
(D) Notification of Vacancies: The City Manager shall
give advance notice to the Miami Beach City Commission,
by notification in the agenda, of any and all future va-
cancies affected by Sec. 2-1.3. 1A.
SECTION 2. REPEAL
All contrary provisions of any Miami Beach policy, legal opinion,
resolution or ordinance are hereby repealed and superseded.
SECTION 3. EFFECTIVE DATE.
This ordinance shall take effect 10 days after adoption in accor-
dance with law, on January 30 , 1982.
