Ordinance 75-2035 ORDINANCE NO. 75-2035 AN ORDINANCE AMENDING CHAPTER 14 OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, BY PRO- , VIDING MINIMUM PENALTIES FOR VIOLATIONS OF CHAPTER 5, SECTIONS 5-1 AND 5-2 OF THE STANDARD NATIONAL FIRE PROTECTION ASSOCIATION, PUBLICA- TION NO. 101 , BEING OTHERWISE KNOWN AS THE LIFE SAFETY CODE (1967 EDITION) AND BEING A PART OF THE METROPOLITAN DADE COUNTY MINIMUM STANDARDS FIRE PREVENTION AND SAFETY CODE, AS ADOPTED BY ORDINANCE NO. 1598, AS AMENDED BY ORDINANCE NO. 75-2031, AND PROVIDING FOR THE ADOPTION THEREOF AS AN EMERGENCY MEASURE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 : That Chapter 14 of the Code of the City of Miami Beach, Florida, be and the same is hereby amended by adding a new Section to Chapter 14 of the Code of the City of Miami Beach, Florida, numbered and reading as follows : "Section 14-74 . 1 Any person, firm or corporation, who shall violate or fail to comply with any of the provisions of Chapter 5, Sections 5-1 and 5-2 , of the National Fire Protection Association, Publication No. 101, otherwise known as the Life Safety Code, 1967 Edition, and which is a part of the Metropolitan Dade County Minimum Standards Fire Prevention and Safety Code, as adopted by Ordinance No. 1598 , as amended by Ordinance No. 75-2031, shall, upon conviction, be fined not less than One Hundred Dollars ($100 . 00) for the first violation; not less than Five Hundred Dollars ($500. 00) for a second violation; and, not less than One Thousand Dollars ($1,000 . 00) for each subsequent violation. In addition, the municipal judge, or associ- ate judge, may, in his discretion, impose an additional penalty of imprisonment for a period of up to ninety (90) days. Each day such violation shall be permitted to exist shall constitute a separate offense. " SECTION 2: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3: That the City Council of the City of Miami Beach, Florida, having found and determined that a public emergency exists affecting life, health, property or public safety, this Ordinance is hereby adopted as an emergency measure and shall go into effect immediately upon its adoption.
