Ordinance 75-2040 Approved by T. D. A. July 31 , 1975. ORDINANCE NO. 75-2040 AN ORDINANCE AMENDING SECTION 41-67 OF THE CODE OF THE CITY OF MIAMI BEACH PROVIDING FOR CIVIL SERVICE STATUS FOR CERTAIN EMPLOYEES OF THE MIAMI BEACH TOURIST DEVELOPMENT AUTHORITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 . That that portion of Section 41-67 of the Code of the City of Miami Beach, Florida, reading as follows : "The employees of the tourist development authority shall not be deemed to have civil service status ; provided, however, that any employee having civil service status and who is transferred to the authority, shall continue to possess such civil service status . " be and the same is hereby amended to read as follows : "The employees of the tourist development authority shall not be deemed to have civil service status ; provided, however, that any employee having civil service status and who is transferred to the authority, shall continue to possess such civil service status , and, provided, further, that employees of the City who possessed civil service status at the time of their transfer to the tourist development authority and who thereafter received a promotional appointment in accordance with civil service procedures shall be deemed to be a promoted civil service employee, and entitled to all civil service rights and benefits as such promoted employee. " SECTION 2. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3. RESOLUTION OF THE MIAMI BEACH TOURIST DEVELOPMENT AUTHORITY APPROVING ORDINANCE NO. 75-2040 OF THE CITY OF MIAMI BEACH PROVIDING FOR CIVIL SERVICE STATUS FOR CERTAIN EMPLOYEES OF THE MIAMI BEACH TOURIST DEVELOPMENT AUTHORITY. WHEREAS Section 41-71 of the code of the City of Miami Beach requires the affirmative vote of the members of the Authority in addition to the affirmative vote of a majority of the members of the City Council; and Whereas Ordinance 75-2040 was passed and adopted July 16, 1975, by the affirmative vote of the City Council; NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE MIAMI BEACH TOURIST DEVELOPMENT AUTHORITY; Section 1. That they hereby approved Ordinance 75-2040 of the City of Miami Beach, copy of which is attached to and made a part hereof . Section 2 . That a certified copy of this resolution be forwarded to the City Manager for filing with the City Clerk.
