AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE
OF THE CITY OF MIAMI BEACH BY ADDING NEW SECTIONS
THERETO REQUIRING PUBLIC HEARINGS PRIOR TO THE
ADOPTION OF RESOLUTIONS CALLING SPECIAL ELECTIONS
FOR THE APPROVAL BY THE ELECTORATE FOR THE
ISSUANCE OF GENERAL OBLIGATION BONDS; AND, REQUIR-
ING PUBLIC HEARING PRIOR TO ADOPTION OF
RESOLUTION AUTHORIZING ISSUANCE OF REVENUE BONDS;
AND REQUIRING PUBLIC HEARING PRIOR TO ADOPTION OF
RESOLUTION AUTHORIZING THE VALIDATION AND ISSUANCE
OF GENERAL OBLIGATION OR REVENUE BONDS WHERE MORE
THAN 18 MONTHS HAVE ELAPSED FROM A SPECIAL
ELECTION AUTHORIZING THE ISSUANCE OF GENERAL
OBLIGATION BONDS OR THE ADOPTION OF A RESOLUTION
AUTHORIZING THE ISSUANCE OF REVENUE BONDS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Chapter 2 of the Code of the City of Miami Beach
be and the same is hereby amended by adding new sections
thereto, immediately following Section 2-1. 2, to be numbered and to
read as follows :
"Section 2-1 . 3. General Obligation Bonds .
The City Council shall not pass or adopt any
resolution, ordinance or other measure, for the
calling of a special election for the submission
to the electorate, for its approval or disapproval,
of the issuance of general obligation bonds,
unless a public hearing is first held by the City
Council following public notice published in a
newspaper published in Miami Beach, not less than
thirty (30) days prior to such public hearing.
Said public notice shall set forth and describe
in detail the amount, the nature, the maximum
rate of interest, and the purpose of the bonds
proposed to be submitted to the electorate at
such proposed special election. "
"Section 2-1. 4 . General Obligation Bonds.
Where the issuance of general obligation bonds
has been approved by the electorate at a special
election held for that purpose and in accordance
with the law, and eighteen (18) months or more have
elapsed since such approval by the electorate,
the City Council shall not adopt any resolution
or other measure authorizing the validation of
such bonds unless and until a public hearing has
been called and held by the City Council in
accordance with the provisions of Section 2-1. 3. "
"Section 2-1. 5. General Obligation Bonds.
Where general obligation bonds have been authorized
and approved in compliance with the provisions of
Sections 2-1. 3 and 2-1. 4 , and eighteen (18) months
or more have elapsed since the validation of said
general obligation bonds, no resolution or other
measure shall be adopted by the City Council

authorizing the sale of such bonds unless and
until a public hearing as prescribed and set
forth in Section 2-1. 3 has been duly called and
held by the City Council. "
"Section 2-1 . 6 . Revenue Bonds .
The City Council shall not pass or adopt any
resolution, ordinance or other measure for the
issuance of any revenue bonds of this City
unless a public hearing is first held by the
City Council following public notice published
in a newspaper published in Miami Beach, not less
than thirty (30) days prior to such public
hearing. Said public notice shall set forth and
describe in detail the amount, the nature, the
maximum rate of interest, and the purpose of
the bonds proposed to be issued. "
"Section 2-1. 7 . Revenue Bonds .
Where a period of eighteen (18) months or more
has elapsed following the adoption of a resolution,
ordinance or other measure by the City Council
authorizing and directing the issuance of revenue
bonds in compliance with the requirements of
Section 2-1. 6 , no resolution or other measure shall
be adopted by the City Council authorizing and
directing the sale of such revenue bonds unless
and until a public hearing has been called and
held in accordance with the provisions of Section
2-1. 3. "
SECTION 2 : That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3: This ordinance shall go into effect immediately upon
passage and posting as required by law.

Miami Beach, Florida, has been posted by me at the door of the City Hall
in said City on the 15th day of December , 1975,
and that said Ordinance remained posted for a period of at least thirty
days in accordance with the requirements of the City Charter of the said
City of Miami Beach.
