AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA
AMENDING CHAPTER 44 OF THE CODE OF THE CITY OF
MIAMI BEACH BY THE ADDITION OF SECTION 44-27A;
PROHIBITING THE PARKING OR STOPPING OF VEHICLES
IN OFF-STREET PARKING SPACES DESIGNATED FOR THE
USE OF THE PHYSICALLY HANDICAPPED, EXCEPT THOSE
DISPLAYING A MOTOR VEHICLE LICENSE PLATE ISSUED
BY THE DEPARTMENT OF MOTOR VEHICLES AND DISPLAY-
ING THE INTERNATIONALLY-ACCEPTED WHEELCHAIR
SYMBOL, HANDICAPPED PARKING PERMIT OR DISABLED
VETERAN MOTOR VEHICLE LICENSE PLATE; PROVIDING
PENALTIES FOR VIOLATION THEREOF; REPEALING ALL
ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR
SEVERABILITY AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1
That Chapter 44 of the Code of the City of Miami Beach be amended by
the addition of Section 44-27A providing:
Sec. 44-27A Prohibition of Parking or Stopping in Park-
ing Spaces Designated for the Use of the Physically Han-
dicapped.
The parking or stopping of motor vehicles in off-
street parking spaces, owned, operated, leased or li-
censed by the City of Miami Beach and designated for the
use of the physically handicapped, except those display-
ing a motor vehicle license plate issued by the Depart-
ment of Motor Vehicles and displaying the international-
ly-accepted wheelchair symbol, handicapped parking per-
mit or disabled veteran motor vehicle license plate is
prohibited.
SECTION 2 PENALTIES
Persons convicted of violating this ordinance shall be subject to a
fine of not less than $50 .00 .
SECTION 3 REPEALER
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 4 SEVERABILITY
If any article, section, subsection, sentence, clause, phrase, or
portion of this ordinance is, for any reason, held invalid or un-
constitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not effect the validity of the remaining portions
of this ordinance .
SECTION 5 EFFECTIVE DATE
This ordinance shall take effect ten (10) days after adoption in ac-
cordance with law, on November 13 , 1982 .
