AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, IMPOSING A MORATORIUM
ON ACCEPTING ANY NEW APPLICATIONS FOR ADULT
CONGREGATE LIVING FACILITIES FOR NINETY DAYS
OR UNTIL A NEW ORDINANCE REGULATING ADULT
CONGREGATE LIVING FACILITIES IS ADOPTED, WHICH-
EVER IS SOONER; SPECIFICALLY EXCEPTING APPLICA-
TIONS PENDING BEFORE THE MIAMI BEACH PLANNING
BOARD AND THE MIAMI BEACH CITY COMMISSION;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
PASSAGE AS AN EMERGENCY MEASURE EFFECTIVE
IMMEDIATELY.
WHEREAS , the City of Miami Beach is deluged with
applications for Adult Congregate Living Facilities , and our
ordinance is inadequate to properly address the regulation of
Adult Congregate Living Facilities ,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1:
No new applications for Adult Congregate Living Facilities will
be accepted by the City for a period of ninety days or until a
new ordinance regulating Adult Congregate Living Facilities is
adopted, whichever is sooner, specifically excepting those ap-
plications that are pending before the Miami Beach Planning Board
and the Miami Beach City Commission as of the effective date of
this ordinance.
SECTION 2 : OTHER ORDINANCES
All ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
SECTION 3 : SEVERABILITY
If any article , section, subsection, sentence , clause , phrase , or
portion of this ordinance is , for any reason, held invalid or un-
constitutional by any court of competent jurisdiction, such portion
shall be deemed a separate , distinct and independent provision and
such holding shall not effect the validity of the remaining portions
of this ordinance.
SECTION 4 : EFFECTIVE DATE
This Ordinance is enacted as an emergency measure to take
effect immediately.
PASSED and ADOPTED this 15th day of December, 1982 ,
as an emergency measure.
