AN ORDINANCE AMENDING CHAPTER 36, SECTION 36-
13.1 OF THE CODE OF THE CITY OF MIAMI BEACH,
FLORIDA; PROVIDING REGULATIONS FOR NON-
CONFORMING ROOF SIGNS; PROVIDING FOR
SEVERABILITY AND REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA;
SECTION 1:
That Chapter 36, Section 36-13.1 of the Code of the City of Miami
Beach, Florida be and the same is hereby amended to read as
follows:
Section 36-13.1 ROOF SIGNS.
No permits shall be issued for new roof signs after the effec-
tive date of this Beet}es ordinance. Signs in existence at
the time of the passage of this seet}en et as amendment thete-

be remeved- provided that:
1.
Such non -conforming signs may be restored or repaired if
the same are destroyed to the extent of not more than
fifty per cent of their reasonable value, by fire, storm
or other casualty;
2. Such signs are properly maintained. To insure such
proper maintenance, each such sign shall secure a permit
and be inspected yearly by the City of Miami Beach.
Failure to obtain such a permit shall be cause for remov-
al of the subject sign;
3. Such non -conforming signs may not alseT during seep
pet€ed7 be altered in lettering or content to show change
of use or ownership of the premises or business advertis-
ed by such signs , but must be removed if the advertised
building or business is sold or changes ownership in any
manner. Further, such signs shall be removed if the copy
is modified, altered or changed.
SECTION 2: SEVERABILITY.
If any section, sub -section, sentence, clause, phrase or portion of
this Ordinance is, for any reason, held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be
deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portions of
this Ordinance.
SECTION 3: REPEALER.
That all Ordinances or parts of Ordinances in conflict herewith be
and the same are hereby repealed.

This Ordinance shall take effect 10 days after adoption on
March 13 , 1982.
