Ordinance 83-2361 • ORDINANCE NO: 83-2361 AN ORDINANCE AMENDING CHAPTER 26, SECTIONS 26-4.B AND 26- 4.D OF ZONING ORDINANCE NO. 1891, TO PROVIDE FOR AN INCREASE IN THE MEMBERSHIP OF THE HISTORIC PRESERVATION BOARD FROM ELEVEN (11) MEMBERS TO THIRTEEN (13) MEMBERS; SAID INCREASE TO CONSIST OF TWO ADDITIONAL AT- LARGE MEMBERS; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH PROVIDING FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 26-4.B and Section 26-4.D of Miami Beach Zoning Ordinance No. 1891 are hereby amended to read as follows: "26-4.B MEMBERSHIP The Historic Preservation Board shall be composed of eleveA 444) thirteen (13) members. There shall be one architect and one landscape architect, both registered in the State of Florida; one builder, developer or general contractor with considerable construction experience on Miami Beach; one historic preservationist or historian qualified by education and practical experience in the rehabilitation of historic structures; five members as follows: a registered real estate broker; a hotel owner; an apartment building owner; an owner of a commercial property in the City, and a person holding an executive position in a Miami Beach lending institution; and twe four additional reembeFs whe shall be FesideAts and veteFs withift the City of Mtar i geaeh members-at-large. All members of the Board shall be residents of, or have business interests in, the City of Miami Beach; provided, however, that the City Commission may waive these requirements in the event a person not meeting these requirements is available to serve on the Board and is exceptionally qualified by training and experience, in historic preservation matters. All appointments shall be made on the basis of civic pride, integrity, experience and interest in the field of historic preservation." "26-4.D TERMS OF OFFICE The term of service on the Historic Preservation Board shall be two years. In order to provide continuity, the members of the first Board appointed under this Section shall be appointed as follows: the architect, the landscape architect, the builder, developer or general contractor, and the historic preservationist or historian shall be appointed for a two-year term and the remaining seven M. nine (9) members shall each be appointed for one-year terms. Thereafter, every member appointed shall serve a term of two years." SECTION 2: REPEALER. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3: SEVERABILITY. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is, for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed as separate, district and an independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. SECTION 4: EFFECTIVE DATE. This Ordinance shall take effect 10 days after adoption, on February 26 , 1983.
