AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION
44-56 OF THE MIAMI BEACH CITY CODE TO PROVIDE
THAT UPON EXPIRATION OF A POLICE TOWING
PERMIT, A NEW PERMIT MAY BE ISSUED FOR A
THREE-YEAR PERIOD IF THE APPLICANT IS
RECOMMENDED BY THE CITY MANAGER AS BEING
CURRENTLY QUALIFIED, WHICH RENEWAL IS SUBJECT
TO APPROVAL BY A MAJORITY OF VOTE OF THE CITY
COMMISSION; PROVIDING FOR REPEAL OF CONTRARY
ORDINANCES; PROVIDING FOR SEVERABILITY;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1:
That Section 44-56 of the City Code of the City of Miami Beach be
amended to read as follows:
Section 44-56. Same--Duration of permits.
The issuance of permits on October 1, 1980 shall be by
lottery among the qualified applicants. The first permit
shall be issued for a four year period, the second permit for
a three year period, and the third for a two year period.
Upon expiration of each permit, a new permit shall may be
issued for a three year period and renewed autematleally
every three years thefeafte - to an applicant who is
recommended by the City Manager , pursuant to the provisions
of this article, as being currently qualified and whose
renewal is subject to approval by a majority vote of the city
commission.
SECTION 2: REPEALER
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 3: SEVERABILITY
If any article, section, subsection, sentence, clause, phrase, or
portion of this ordinance is, for any reason, held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions of this ordinance.
SECTION 4 : EFFECTIVE DATE
This ordinance shall take effect ten (10) days after adoption on
June 25 1983 .
