WITNESSETH :
That the City, for and inconsideration of the sum
of Twelve Thousand Three HundredFifteen Dollars and

Seventy-nine Cents ($ 12,315.79) to it in hand paid by the Com-
pany, receipt of which is hereby acknowledged, has granted, bar-
gained, sold and conveyed and by these presents does grant , bar-
gain, sell and convey to the Company its successors and assigns,
all of the following described property in the City of Miami
Beach, County of Dade and State of Florida, more particularly
described as follows:
That part of the combination light and
trolley poles , together with all fixtures
wires and appurtenant equipment above the
street light brackets, except the City
Police and Fire Alarm systems and appurt-
enances thereto , on the combination light
and trolley poles located as follows:
1. 170 poles located on Washington Avenue from
Lincoln Road to Biscayne Street.
2. 12 poles located on Fifth Street from the
East End of the Causeway to Alton Road..
3. 33 poles located on First Street from Alton
Road to Ocean Drive,
4-. 13 poles located on Alton Road from the North
side of Collins Canal to Nineteenth Street , and
5. 6 poles located near 23rd Street Bridge across
Collins Canal.
a total of 234 combination light and trolley poles.
ALSO The right , privilege and easement to use that section of
the above described combination light and trolley poles
below the street light brackets on such poles, to enable the
Company to operate and maintain that section of the poles above
the street light brackets conveyed to the Company , hereunder,
which right , privilege and easements shall be co-existent with
such other right , franchise or otherwise , that the Company and/or
its subsidiaries, their successors and assigns have or may have
to use the streets and other public places in Miami Beach, Flor-
ida; provided, however, that the Company and/or its subsidiaries,
their successors and assigns shall maintain or cause to be main-
tained the above described combination light and trolley poles
for so long as that part above the street light brackets shall
be used and/or kept in place by it or them.
TO HAVE AND TO HOLD the said property and easements and
all and singular the said property and every part thereof, with
the appurtenances, unto the Company, its successors and assigns
forever, except as hereinabove provided as to easements.
AND the said City does hereby fully warrant the title of
the property hereinbefore mentioned and described and will de-
fend the same against all claims of persons, firms and corpora-
tions whomsoever.
IN WITNESS WHEREOF, the said party of the first part has
caused this instrument to be signed and its seal to be affixed
by its duly authorized officers the day and year first above
written.
