Ordinance 83-2389 • ORDINANCE NO. 83-2389 AN EMERGENCY ORDINANCE OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING SECTION 2-1. 3 . 1 OF THE CODE OF THE CITY OF MIAMI BEACH, ESTABLISHING PROVISIONS FOR THE TERMINATION OF OFFICE FOR BOARD AND COMMISSION MEMBERS, BY ESTABLISHING AN EXCEPTION FROM THE TERMINATION PROVISIONS FOR THOSE BOARDS, COMMITTEES, COMMISSIONS OR AUTHORITIES AUTHOR- IZED BY FEDERAL, STATE OR COUNTY LAW; PRO- VIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PASSAGE AS AN EMERGENCY MEASURE. BE IT ORDAINED BY THE CITY COMMISSION BY THE CITY OF MIAMI BEACH: SECTION 1. That Section 2-1. 3 . 1 of the Code of the City of Miami Beach, Florida, establishing the termination of office for board and com- mission members, and the same is hereby amended to read as fol- lows: Section 2-1. 3. 1. Board and commission members-termina- tion of office. (a) Expiration of terms. All persons serving on city boards, committees, commissions or authorities shall cease to hold office when a successor is duly appointed, or sixty days after expiration of the term of their office, (as said term is specified in the ordinance, resolution, or other law creating said office) whether or not a successor has been appointed, whichever occurs first, and such persons shall at that time cease to exercise any rights, power or prerogatives of office . (b) Current members. Any person whose term expired prior to adoption of this section shall cease to hold office sixty days after adoption of this section, or when replaced, whichever occurs first. (c) Exceptions. This section shall not apply to per- sons appointed to serve for a specified term "and until a successor is appointed" (or words to that effect) ; such persons shall continue to serve until reappointed or a successor is appointed by the city commission. This section shall not apply to any board, committee, commission, or authority fequi.red authorized by federal , state or county law. (d) Notification of vacancies. The city manager shall give advance notice to the Miami Beach City Commission by notification in the agenda, of any and all future vacancies affected by Section 2-1. 3 . 1, paragraph (a) . (Ord. No. 82-2293 , §1) SECTION 2. SEVERABILITY. If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder shall not be affected by such invalidity. SECTION 4. EFFECTIVE DATE. This Ordinance shall take effect as of the date of adoption as an emergency measure. ADOPTED as an emergency measure this 5th day of October , 1983 .
