AN ORDINANCE AMENDING CHAPTER 10 OF THE
MIAMI BEACH CITY CODE, ESTABLISHING MUNICIPAL
ELECTION LAWS BY REPEALING SECTION 10-10 ,
PROHIBITING THE SOLICITATION OF VOTES ON
ELECTION DAY; PROVIDING FOR SEVERABILITY;
REPEALING ORDINANCES IN CONFLICT; PROVIDING
FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1.
That Section 10-10 of the Miami Beach City Code, which reads as
follows:
Sec. 10-10. Solicitation of votes at polling
places, etc. and distribution of political
leaflets, etc. , on day of election prohibited.
It shall be unlawful for any person, on the
day of any municipal election, to solicit
votes or approach any elector in an attempt to
solicit votes at any polling place or on any
public street, avenue, walk or other public
way; or to distribute or cause to be
distributed within the city, on the day of
such election, any political cards, handbills,
leaflets, pamphlets or other literature
designed or intended to advocate or to oppose
the nomination or election of any candidate;
provided that the transportation of an elector
to a polling place shall not be deemed a
violation of this section. (Ord. No. 1183,

be and the same is hereby repealed in its entirety.
SECTION 2 . SEVERABILITY.
If any section, sub-section, sentence, clause, phrase or other
portion of this ordinance is, for any reason, held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed as a separate, distinct, and independent
provision, and such holding shall not affect the validity of the
remaining portions of this ordinance.
SECTION 3. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
SECTION 4 . EFFECTIVE DATE.
This ordinance shall take effect ten (10) days after adoption in
accordance with law on April 14th , 1984 .
