AN ORDINANCE AMENDING CHAPTER 44 OF THE MIAMI
BEACH CITY CODE, REPEALING THE REQUIREMENT
THAT THE MIAMI BEACH POLICE DEPARTMENT SUMMON
TOWING FIRMS TO TOW VEHICLE FROM PRIVATE PROP-
ERTY; PROVIDING FOR SEVERABILITY ; REPEALING OR-
DINANCES IN CONFLICT ; PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1 .
That Section 44-65 of the Miami Beach City Code , which reads as
follows :
Sec . 44-65 . Additional standards - police
notification.
In addition to the provisions of §714 . 07 , Fla .
Statutes (1979) , prior to the removal or towing
of any vehicle from private property, the owner
of said property shall inform the Chief of the
Police Department of the City of Miami Beach and/
or his designee who shall have exclusive authority
to summon a towing firm for the purpose of remov-
ing the vehicle (Ord . No . 82-2292 , §2) .
be and the same is hereby repealed in its entirety .
SECTION 2 . SEVERABILITY
If any section, sub-section , sentence , clause , phrase or other
portion of this ordinance is , for any reason, held invalid or
unconstitutional by any court of competent jurisdiction , such
portion shall be deemed as a separate , distinct , and independent
provision, and such holding shall not affect the validity of the
remaining portions of this ordinance .
SECTION 3 . REPEALER.
All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed .
SECTION 4 . EFFECTIVE DATE .
This ordinance shall take effect ten (10) days after adoption in
accordance with law on May 12th , 1984 .
