AN ORDINANCE AMENDING CHAPTER 44, SECTIONS 44-39
AND 44-40 OF THE CODE OF THE CITY OF MIAMI BEACH,
FLORIDA, SO AS TO REFLECT THE CURRENT ZONING USE
DISTRICTS CONTAINED IN ORDINANCE NO. 1891, BEING
THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF
MIAMI BEACH; PROVIDING FOR SEVERABILITY, AND
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: That Section 44-39 of the Code of the City of Miami Beach
is hereby amended to read as follows:
SECTION 44-39 - Restrictions on parking in -'RAA" T -'RA" T -'RB' -'T -'RC -'T
OR - 'RD-' "RS -1", "RS -2", "RS -3, or "RS -4" use districts.
It shall be unlawful for any person to park, or cause to be parked, a
truck, tractor, trailer or semi -trailer upon the public streets in any area
of the City zoned as ''RAA" T '-'RA'-T-'RB'-'T-'RC-'T OR R' -'D' "RS -1", "RS -
2", "RS -3", or "RS -4" use districts, as such districts are shown in
Ordinance No. 1891 of the City, except while loading or unloading
property or when such vehicle is parking in connection with and in aid
of the performance of a service to or on the property in the block in
which the vehicle is parked. (Ord. No. 1119,§1.)
Section 2: That Section 44-40 of the Code of the City of Miami Beach is
hereby amended to read as follows:

"C-3", "C-4", "C-5", "C-6", "RH", "MR", "MU", "CCC", "MD -1", "MD -
2", and "RU" use districts.
It shall be unlawful for any person to park or cause to be parked a
truck, tractor, trailer, or semi -trailer having a net weight of more than

parked (Ordinance No. 1119, §1: Ordinance No. 1429, §1.)
Section 3: REPEALER. All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
Section 4: SEVERABILITY. If any section, sub -section, sentence, clause, or
phrase, or portion of this Ordinance is, for any reason, held invalid
unconstitutional by any court of competent jurisdiction, such portion shall be
deemed a separate, distinct and independent provision and such holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 5: This ordinance shall take effect 10 days after adoption on
May 29 , 1982.
