Ordinance 91-2753 ORDINANCE NO. 91-275 3 AN ORDINANCE AMENDING SECTIONS 45-4 (a) 45- 4 (c) , AND 45-4 (d) OF THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, BY INCREASING THE SCHEDULE OF RATES FOR WATER SUPPLY SERVICE TO NON-MUNICIPAL CONSUMERS OF WATER FROM $1. 17 TO $1.32 PER THOUSAND GALLONS AND INCREASING THE MINIMUM MONTHLY SERVICE CHARGE; PROVIDING FOR SEVERABILITY: PROVIDING FOR AN EFFECTIVE DATE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: 1• That Section A5-4 ( ) ofthe Code the City SECTION Y� � a; _h of City of Miami Beach, Florida, be and the same is hereby amended to read as follows: " (a) The meter rate to non-municipal consumers for water supply service in the territory shall be $1. 17 $1. 32 per thousand gallons. " SECTION 2 : That Section 45-4 (c) of the Code of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: " (c) The water rate of $1. 17 $1. 32 per 1, 000 gallons for non-municipal consumers of water as set forth in Section 1 of this Ordinance is to be applied to all water billings based on meter readings taken on or after January 15, 1991 October 1, 1991. SECTION 3: That Section 45-4 (d) of the Code of the City of Miami Beach be and the same is hereby amended to read as follows: " (d) Every water supply service shall have a monthly minimum service charge on each service installed, varying with and based upon the size of the service pipe required and installed in accordance with the rules of the public works department. This minimum charge shall be in accordance with the following schedule and shall entitle the consumer, without excess charge, to have supplied through the meter the number of gallons of water set forth in the table. " SECTION 4: That all ordinance or parts of ordinances in conflict herewith be and the same are hereby repealed. % SECTION 5: SEVERABILITY: If any section, sub-section, sentence, clause, phrase or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. SECTION 6: This ordinance shall become effective 10 days after adoption on January 19, 1991 October 5 1991. PASSED AND ADOPTED THIS 9TH DAY OF JANUARY, 1991 25th DAY OF September , 1991.
