AN ORDINANCE AMENDING SECTION 9.03 OF CITY OF
MIAMI BEACH ORDINANCE NUMBER 1901; PROVIDING
FOR REPRESENTATION BY THE CITY ATTORNEY WHEN
REQUESTED BY THE BOARD OF TRUSTEES OF THE RE-
TIREMENT SYSTEM FOR GENERAL EMPLOYEES AND
ELECTED OFFICIALS OF THE CITY OF MIAMI BEACH,
VESTING IN THE BOARD THE AUTHORITY TO RETAIN
PRIVATE LEGAL COUNSEL FOR REPRESENTATION THERE-
OF, SUBJECTING RETENTION OF COUNSEL TO THE
APPROVAL OF THE CITY COMMISSION, LIMITING
SAID SERVICES AS TO HOURS AND HOURLY FEE,
PROVIDING FOR THE PAYMENT OF LEGAL FEES FROM
RETIREMENT SYSTEM FUNDS, PROVIDING FOR SEVER-
ABILITY, REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE
THEREFOR.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA:
SECTION 1: That Section 9.03 of City of Miami Beach Ordinance
Number 1901 shall be amended as follows:
9.03 City Attorney
(a) The City Attorney shall serve as legal
adviser of the Board when requested to do so,
and his services on behalf of the Board shall
not be compensated additionally.
Legal Counsel
(b) The Board shall be vested with the
authority to retain private legal counsel
for representation thereof.
(c) Counsel retained hereunder shall be
subject to the approval of the City Com-
mission.
(d) Private Counsel shall provide legal
services to the Board of Trustees as re-
quested by the Board, but not to exceed
100 hours annually at $100.00 per hour.
(e) Legal fees shall be paid solely from
funds of the Retirement System, and not
from funds of the City of Miami Beach
General Fund.
SECTION 2: SEVERABILITY. If any section, sub -section sentence,
clause, phrase or portion of this Ordinance is, for any reason
held invalid or unconstitutional by any court of competent juris-
diction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the
validity of the remaining portions of this Ordinance.

SECTION 3: REPEALER. All ordinances or parts of Ordinances in
conflict herewith be and the same are hereby repealed.
SECTION 4: This Ordinance shall take effect 10 days after
adoption, on 7/17 , 1982.
