AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA AMENDING SECTION 25-
33(P) OF THE MIAMI BEACH CODE, MAKING IT UNLAW-
FUL FOR ANY PERSON TO LODGE WITHIN VEHICLES
WITHIN THE CITY OF MIAMI BEACH.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI
BEACH, FLORIDA:
SECTION 1
Subsection 25-33(C) of the Miami Beach City Code is hereby repealed
in its entirety and replaced by the following subsection:
"(0 Sleeping or lodging between dusk and dawn in the
open air, or on public streets, alleyways or beaches, or
within buildings or other places not designed for human
habitation, or within vehicles, including recreational
vehicles, cars, vans or trucks whether or not designed
for human habitation; provided however that this subsec-
tion shall not apply to persons forced to sleep or lodge
within such buildings or vehicles due to hurricane, tor-
nado, fire or Act of God; and provided further that the
City Manager is hereby authorized to issue permits to
persons allowing them to sleep or lodge for a period not
exceeding five days within vehicles designed for that
purpose during conventions, festivals or other events or
occurrences justifying the same, and the City Manager
shall be authorized to issue stickers or numbered permits
for that purpose and impose such reasonable conditions
for such permits as he or she deems to be in the public
interest and welfare.
SECTION 2 REPEALER
This ordinance shall repeal all ordinances to the contrary within
the City of Miami Beach Code
SECTION 3 EFFECTIVE DATE
This ordinance shall take effect 10 days after its adoption on
August 28, 1982.
SECTION 4 SEVERABILITY
If any section, subsection, sentence, clause, phrase, or portion of
this Ordinance is, for any reason, held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be deemed
a separate, distinct and independent provision and such holding
shall not effect the validity of the remaining portions of this Or-
dinance.
