Ordinance 82-2330ORDINANCE NO, 82-2330 AN ORDINANCE AMENDING CHAPTER 25 OF THE CITY CODE AND ENACTING A NEW SECTION 25-92.2 AUTHORI- ZING THE CITY TO ORDER COMPLIANCE BY OWNERS OF VACANT, UNOCCUPIED, CLOSED OR UNFINISHED STRUC- TURES WITH SPECIFIC MAINTENANCE PROCEDURES; AUTHORIZING THE BUILDING OFFICIAL OR HIS DESIG- NEE TO ENACT RULES AND REGULATIONS REGARDING THESE PROCEDURES; PROVIDING LIEN AGAINST PRO- PERTY IN EVENT OF NONCOMPLIANCE; PROVIDING FOR SEVERABILITY; PROVIDING FOR PASSAGE AS AN EMER- GENCY MEASURE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 LEGISLATIVE PURPOSE In an effort to protect the safety of neighboring residents and pro- perty of unsecured structures, Chapter 25 of the Code is hereby amended by the addition of a new §25-92.2 which reads as follows: Sec. 25-92.2. Unfinished, Vacant, Unoccupied, or Closed Structures -- Maintenance Procedures Required of Owners. A. All owners of unfinished, vacant, unoccupied, closed or unfinished structures or buildings shall comply with rules and regulations relating to such structures or buildings as promulgated by the Building Official. These rules and regulations shall specify those actions and time limits within which owners shall beautify, secure and/or patrol their structures or buildings. B. Noncompliance with the aforesaid rules and regula- tions shall be punishable in a manner as provided in §1.8 of the Miami Beach City Code. Noncompliance with the rules and regulations may result in the City taking such action as it deems appropriate under the circumstances, and a lien shall be imposed against the structure or building for recovery of all costs involved. SECTION 2 OTHER ORDINANCES All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3: SEVERABILITY. If any article, section, subsection, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or un- constitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not effect the validity of the remaining portions of this Ordinance. SECTION 4 EFFECTIVE DATE. This is an emergency measure and shall take effect immediately. PASSED and ADOPTED this 18th dayf August 1982.
