AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, AMENDING MIAMI BEACH CITY CODE
CHAPTER 9B, ENTITLED "CODE ENFORCEMENT" BY
ADDITION OF A NEW SECTION 9B-11, ENTITLED
"REHEARINGS", PROVIDING THAT UPON TIMELY
FILING OF A PETITION BY A VIOLATOR OR BY THE
CITY ADMINISTRATION, A SPECIAL MASTER OR CODE
ENFORCEMENT BOARD MAY REHEAR A CASE, CONSIDER
ADDITIONAL TESTIMONY AND ISSUE A NEW ORDER;
DIRECTING THAT THE CURRENT SECTIONS 9B-11
THROUGH 9B-13 BE RENUMBERED AS 9B-12 THROUGH
9B-14; PROVIDING FOR SEVERABILITY; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1.
That Miami Beach City Code Chapter 9B, entitled Code
Enforcement" is hereby amended by addition of a new Section 9B-11,
entitled "Rehearings" to read as follows:
SEC. 9B-11. Rehearings.
Upon filing of a Petition for Rehearing by a violator or
by the City Administration, a Special Master or Code
Enforcement Board may rehear a case, take additional

rehearing is granted, or 2) the Board or Special Master
has over-looked or failed to consider something which
renders the order issued erroneous. A Petition for
Rehearing must be filed within thirty (30) days of the
filing of the last order issued in the case.
SECTION 2 .
That the City Clerk is hereby directed to renumber the current
Sections 9B-11 through 9B-13 as new Sections 9B-12 - 9B-14 .
SECTION 3. Severability.
If any section, subsection, clause or provision of this
Ordinance is held invalid, the remainder shall not be affected by
such invalidity.
SECTION 4. Repealer.
All Ordinances or parts of Ordinances in conflict herewith be
and the same are hereby repealed.
SECTION 5. Effective Date.
This Ordinance shall take effect on the 15th day of February ,
1992.
